Lease car - transfer of liability communication

Hello, hoping for some advice please.

I have read through the hire section of the newbies thread but I'm still unsure about the following:

I received a letter from the company I lease a car through saying a parking charge has been issued. The letter says they have given my details to the relevant authority transferring liability and they will contact me directly. I have not heard anything from the parking company yet.

So my question is; should i wait until I hear directly from the parking company before appealing?

Since I haven't heard from the parking company yet I'm starting to become concerned I should have contacted them as soon as I became aware of the charge.

Many thanks in advance.

    It will come in time
  • Original poster here again.

I have still received nothing from the PPC.

But I have received a new letter from the lease company which contains a reminder notice from the PPC stating that the PCN is overdue and the charge is now £100. The letter again states that they have given my details to the relevant authority transferring liability to me and that the authority will contact me directly.

It looks like the opportunity to appeal has passed, the charge has now increased and I have still heard nothing directly from the PPC.

Does anyone have any advice on how to proceed?

    Thanks again in advance.

And tell the lease firm that if they have transferred liability then they MUST NOT pay it because it is de facto not their business any more - it's ONLY yours - and you choose to appeal and will not be paying the scam.

Email and ask for a copy of what they say they sent and ask them to re-send it to the scammers, to be sure.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • What is the name of the parking company?

In recent months one or two parking companies have become rather awkward with lease companies - i.e. they will not accept a transfer of liability to the hirer unless all of the relevant hire documents are handed over.

UKPC Ltd have been the most awkward for quite some time and we now have PCM (UK) Ltd and even Euro Car Parks Ltd joining in by declining to transfer liability to the hirer unless the lease company supplies the relevant documents.

Of course this shouldn't matter because once the hirer has been identified (with or without the documents) this should be enough to absolve the lease company from liability anyway - i.e. it is proven that the "keeper" for the purposes of POFA was not the registered keeper. The problem is that most lease companies do not like the hassle of still being chased for payment.

C-M's suggestion that this could relate to Newcastle Airport makes sense. The byelaws there keep the registered keeper in the frame and UKPPO will not accept any transfer to the hirer - as one of my friends found out recently.
