    As a company I believe that you could ask for evidence etc under the pre action protocols, I think these changed almost 2 years ago ?

    You can't just go on a fishing expedition though when requesting information under the Pre-action Protocols whereas a SAR is nothing other than a fishing expedition requesting every single piece of information that is held.

    Saying what they can't do isn't helping without stating what they can do

    It's easy to criticise but one thing going for those replying is they are trying to give genuine help

    The pre action protocols have been mentioned with template letters , so nothing to stop the OP sending that template letter to the claimant or their legal agents

    The fact they may not get a reply doesn't stop them from doing it and adding to their bundle, as we have seen in previous company threads on here

    It's called clarifying the issues , so a good idea prior to a court claim so that a judge can see the defendant tried to sort it out prior to court
