Estate Agent Relisted Property After Exchange

I recently exchanged on a flat due to complete at the end of next week. I have just noticed that the agent has put the property up on rightmove as a premium listing. There is no sign of it on their own website. Should I be concerned or is this a ploy to drum up interest in other properties they have? Is there anything I can do about it?

    What could you possibly be concerned about?

    You've just exchanged. Nothing is going to happen.

    It's either a mistake or they put it up for a bit of last minute attention and will disappoint people and recommend other flats instead.

    No point in even bothering to question the agent's motives or incompetence. Just get on with your life and prepare to enjoy your new home. :)

    Maybe.

    No. Why would you want to? They're contractually bound to sell the property to you.

    This is assuming you have actually exchanged contracts and not merely e.g. signed things in advance of exchange.

    The EA aren't. The EA can't sell it to you, because they don't own it.

    The vendor is contractually bound... and almost certainly not involved in the EA's listing of the property.

    It's very simple - if you think there's something odd going on, get a friend to phone the EA and enquire about the property.

    It could be that they are trying to drum up more business and done on purpose or it could be a simple mistake and the wrong listing was made premium. Either way there is nothing for you to worry about because you've already exchanged contracts.l

  • I think the last place I pulled out of had their listing re-advertised for five days before it was removed.

    I know the seller would have to breach the contract if it meant anything - I just think it's unethical to advertise something that isn't available. More to the point it's been 6 months of pain to get to this point and the agent knows that.

    As others have said, but have you actually exchanged contracts or just sent the signed copy back to your solicitors? If the former, nothing to worry about.


    If you're not sure of the process and legal obligations at this stage, I suggest a conversation with your solicitors tomorrow.
