Advice needed

Hi,

I brought a tv screen from amazon. There was a fault with the screen, unfortunately the replacment was out of stock and was going to.be 2-3 months. I raised this with the manufacturer who instead replaced the item as it was going to be a long wait otherwise. Unfortunately the replacment is also faulty. The manufacuer this time are being difficault and want me to this time send it for 'inspection' which can take up to a month for them to 'decide' if they will replace it. I am instead sending the item back to amazon for a refund as i have no faith in the product and can do without the stress of sending things backwards and forwards. I am still within 30 days from purchase. Am i entitled to a refund from amazon even though the manufacuer has attempted to replace it?
I didn't want to go through the manufacturer, but felt i had no choice as Amazon did not have stock.
I just want a working unit which i paid for, the item i will be returning to amazon is the replaced item which i am worried about. However this and the original both have faults.
I did not pay on credit card (lesson learned) however it is not my fault. As a customer i just want a working item and not expect to wait a month whilst the manufacturer 'inspects it. It is clear from photos i sent them that there is a fault.

    So you want Amazon to refund the replacement screen that they didn't send you? Good luck with that.

    You have complicated things now as you cannot supply the original screen to Amazon. I din't think thr manufacturer is being difficult - they are entitled to confirm there is a fault.

    But isnt my contract with amazon, im sorry i may have been a bit niave, however it is simple, i paid for something and it does not work out of the box. It is not ny fault they went able to replace it.

    Its down to Amazon now .
    Amazon may inspect/ check serial numbers etc and reject as not the item sold .
    Your contract is with Amazon for the goods you bought .
    But you are not returning those goods but some other goods . even though the same make .


    Original TV amazon sold .
    Returned TV amazon did not sell .

    So why did you go to manufacturer?

    Amazon may not have any way of identifying it wasn't the original screen they sold you and you may get away with it. That is if it was bought direct from Amazon and not a 3rd party seller.

    I asked the manufacer for advice what to do as amazon had no stock and couldn't replace it for months. Yes i should have got a refund instead, but i did not expect the replacment to be faulty. So now as a customer i am being rather inconvenienced

    By going through the manufacturer you have complicated your rights with the retailer.

    If Amazon had said contact the manufacturer then that would have been ok. You could have also returned it to Amazon for a refund initially when they couldn't replace it.

    You have chosen the manufacturer warranty route rather than the consumer rights act with the retailer, so need to stick with what the manufacturer is offering.

    It's a shame you didn't post here as soon as the TV was faulty but at least you will know for next time.
