    There is signage up (checking street view) plus markings on the road saying residents only
  • No claim form received from the court as you would normally get it and ask to do an AOS and defence
    Hang on. Have you received a judgment that requires you to pay a sum of money or have you received “general form of judgment/order” which is a court template and, in effect, allows a judge to order anything. Your note suggests you’ve been ordered to do a defence.

    You get out what you put in: write in incomplete sentences, fail to explain all circumstances or to set out parking signage and the help you’ll get is necessarily limited by that.

    What EXACTLY does the order say and what is the date of it?

    it is titled: judgement for claimant (in default)
    dated 16th Aug 2019

    you have not replied to the claim form. it is therefore ordered you pay the claimant £xxx for debt and £xx for cost

    i double checked it by calling the court and seems correct
  • Ok. So you've lost 10 days. If you were going to apply to set aside, remember the requirement to act promptly.

    Obviously you need a copy of the claim form to see if it has been served to the correct address. Same initial issue: If your o/h is the keeper, this is his judgment not yours. Failure to set out a full name is a breach of the CPR, but unlikely a huge amount turns on that.

    I’ll read up later on the six point draft and ask whether they want to fight or pay

    You're probably also still within time to pay the dollar and make this all go away without the CCJ being registered on anyone's credit report.

  • WIth this now being settled I.e. paid

    Is it possible and/or worth claiming some money back via smaller court. Obviously lba et al but in a way fight it back

    It won’t be so much the parking but the process such as abuse of process etc and unfair add ons

    I did read a thread where this was briefly mentioned
