Hi forum
I was hoping the people may be able to help me
Received a default judgement from PCM via Gladstone crooks.
I’m not sure if I have a case to set aside. Having read previous threads and post for so long - bit confused
I received a letter from Gladstone’s saying they was going to send a claim if I did not respond or along those lines
So jumped on here and sent through a SAR request.
That was over a month ago between then and now the default was received in the post. No claim form received, no chance to defend the case like I’m doing with another ‘parking’ co. (Thread to come on the later)
Address has been fine albeit I don’t know how they managed obtain the registered keeper and just use an initial surname when there’s two people with the initial. Minor probably
What would you advise to do here?

Sorry does the claim form have a full name at your correct address. Have you even seen it?
How come you know if the judgment but have not seen the proceedings
Don't ask us if you have a good reason to set aside tell us why you did not or could not have dealt with the proceedings sent to you0 -
No - none of the correspondence has a full name - the letters from the DC and gladston were title A Surname - even the judgement from the CCBC was titled the same

Is the address on the vehicle V5 correct as that is where all correspondence would have been sent? Have you moved at some point since the date of the alleged event?I married my cousin. no change in address - i have just quickly looked through the paperwork from the SAR - they managed to get details via DVLA so had the full name within their possession

I am not sure what that means, are you saying that the judgement was not sent to your address but elsewhere?You never know how far you can go until you go too far.0 -

the judgement was address as A.SURNAME instead of FIRST NAME SURNAME

Why did the vehicle receive a parking charge notice?
whos car park was this?
where was the car park?
What documentation did you receive from the parking company ( if any)?
and what did you do with it ( if you received anything)? ( did you bin it/ignore it etc)?
What ( if any) documentation did you receive to indicate that court proceedings were commencing, LBA/claim form etc?
did you ignore these ( if you received them)?
Your username is not for real, basing that on being your name...
Did you ignore everything because it was addressed to a Mr N.F. Real and not to mr Not For real?? and you used that as a justification to ignore everything based on the idea that as its ( in your opinion) improperly addressed it can be ignored??From the Plain Language Commission:

Post 7 does not answer my question. Clearly others are as confused about the circumstances surrounding the CCJ as am I.
As HW says, please start at the beginning, and check that it makes sense before you post it as the events you have described do not add up. We cannot advise unless we know the problem.You never know how far you can go until you go too far.0 -
A visit to a supermarket was made and the car park was being worked on therefore reduced capacity. There is an housing estate which to get to you go through the supermarket car park. Thought nothing of it wasn’t going to be long.
On reflection I realised the parking attendant was sitting in their car all along so seems pre planned
Offence is parking without a permit. I ignored all letters (now know not the case for all) until recently.
2 letters from PCM about the offence back in 2017 sent to RK - mr not for real
After that nothing. Was passed on to DRP then Gladstone’s who issued a LB. After that I made a SAR request to PCM which gave the first para above
A month after receiving the data a judgment was given in the post address to Mr NF real
No claim form received from the court as you would normally get it and ask to do an AOS and defence

So, you parked on the housing estate?
It may not have been pre planned (as in a trap). The residents may well have got fed up with supermarket customers parking on their private land and requested an attendant be there. I know (and agree with) many of the comments about rapacious PPCs but there are times when it is about inconvenience too
I suspect this is going to turn on signage. Were there prominent signs etc0
