NCP have responded to say that they don't hold any more information about the vehicle in question.
The registration is on the letters from Trace and would presumably have been on the letters to the registered keeper. Will file a complaint with the ICO.
Is there anything else to do, or is this now just a waiting game?0 -
Send NCP's reply to Trace and ask how they got your data and who from, since NCP have confirmed they hold no data.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No response from Trace on the SAR... but did receive more letters from them giving seven days before they pass the matter on to solicitors.0

They’ve got 30 days to respond to a SAR. thereafter send them a reminder with a 7-day deadline threatening reporting them to the ICO. If no satisfactory (or any) response, carry out your threat. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Trace has responded to the SAR by providing copies of the letters they have already sent. They have provided nothing else - no internal notes about the case, no correspondence to them from NCP, zilch.
Trace mentioned in the response that they have spoken to NCP, but they provided no record of that interaction in the SAR response attachments.
In summary, I am left with the following:
*NCP offering no evidence of the alleged parking offences
*NCP offering no evidence that they wrote to the registered keeper to tissue a PCN
*Trace offering no evidence that NCP has instructed them to act on their behalf
Will send a response asking them to double-check their records, but is there anything else I should do at this stage? The seven day 'final demand' deadline from Trace looms.0 -
I would report Trace to the ICO for processing data they were never entitled to hold, and if that turns out not to be the case, then they have withheld data in the form of the communications and file notes/status reports which came to them from NCP, despite them admitting they had had contact with NCP about you.
Go to the ICO website and 'report a concern' about Trace.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
