  • The garage refused to fix the faults. When I asked for them to be repaired under the consumer credit act (after he said no) he told me to put it in writing and then refused any further communication with me

    If / When you issue court proceedings issue them in the person's name trading as Jordan James Motor Company. This enables enforcement to be easier. Not worth their while fighting over £2000 though surely they will just pay up?

    Edit: Looks like the owner is called Chris Cash
  • He is called Chris Cash! The only thing is, I've read that if I put it as a person's name (say Mr Cash) rather than the company I will have to go to their court where as if I put it to Jordan James they (Mr Cash) will have to come to my court?

    Is this a Ltd company or an individual trading under a company name?

    If it's a Ltd company you put the company name. If it's an individual you put his name t/a the company. He will have to come to you if he's a company.
  • I'm pretty sure it's a LTD company and he's the owner / sales man. Well I'm completing the court forms this weekend so wish me luck! I believe he has 2 weeks to respond to the court

    You need to know rather than being "pretty sure". If you put the wrong entity down then the claim can very likely be thrown out.

    I can't see the company or the owner listed at Companies House so it looks like he's a sole trader not a Ltd company.

    In that case list Mr xxx t/a then company name.
