If the Claimant doesn't re-file the claim within six months, then then CPR's say it is automatically stayed, and there's a fee to reinstate.
That's good news, at least there is some kind of expiry date :T
Should I call the court and find out whats happening or is the best thing to do to remain quiet?0 -

Hi all,
Need some urgent advice please. So I moved address again in April 2020. Have just had a credit report alert that I have been given another CCJ for this same case number for £887 on 2nd December 2020. Again without my knowledge due to not receiving the claim forms, or any emails or telephone calls from Gladstone’s, who have been given my correct telephone number and email address. Can anyone advise me on where I stand? I really really begrudge this, but I feel I just want to pay it to put an end to the matter and the damage to my credit report. Would I be able to make another application to set aside (with consent) so I can end this worrying situation, or is this now not possible as I have already previously set aside? Thanks in advance0 -
If the judgment was dated 02/12/20, then it's too late to pay to protect your credit rating, the damage is done if payment isn't made within one month of the judgment. Paying will just launch your £800+ into a black hole and your credit rating remains trashed. Don't do that .... !
Please read the NEWBIES FAQ sticky, second post, on how to make a set aside application, read other set aside threads (there are plenty across the forum) and read posts by forum set aside expert @henrik777.Come back when you've got your strategy worked out. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Were they given you correct ADDRESS? When you moved, did you update them and the PPC? If not, why not? You know you had a live claim possible!0

Is this the same circumstances and the same case as the one you posted about when you started this thread. Last info posted was that you had received a set-aside but then it all went quiet.0

Yet another new user as well.0

Yes exactly the same case number. I assumed (wrongly) that the claimant had 6 months to reissue the claim and once that time had elapsed meant they weren’t going to pursue it. I never heard anything further about the matter following the set aside order through the post from the court. I’m guessing that I won’t have much luck attempting another set asideLe_Kirk said:Is this the same circumstances and the same case as the one you posted about when you started this thread. I take full ownership of the fact this was not done. Thought it was the end of the matter as I was advised they had 6 months from the date of set aside. Maybe this was incorrect advice. I moved to temporary accommodation during lockdown last year and this wasn’t even a consideration in my mind at the timenosferatu1001 said:Were they given you correct ADDRESS?
