That's their standard response. It crops up an awful lot on here.
  • Whether or not it's a good thing that scammers are (diligently :) ) trying to find your current address, that they have access to credit reference agency files is very worrying and should be taken up with the ICO and your MP. Whilst it used to be the case that the CRAs made a big thing about how you always had to give permission for a search, they've quietly dropped that one, given that the ICO state that no permission is necessary; all that's needed is a valid reason. From the data protection and privacy point-of-view it matters not whether the search is hard or soft. The facility should not be available to parking scammers. End of story.

And here's me thinking I explained why it should be available and used.

One PCN issued on 20/04/2018 and the other on 16/06/2018. I also have another claim for which I am currently submitting the directions questionnaire, which is in reference to another PCN also issued on 20/04/2018.
With the Directions Questionnaire add in a covering email asking for the case to be directly referred and allocated specifically to DJ xxxx at xxxxx court who has already consolidated two other claims of similar fact from the same claimant and that this one too, should be added to the December hearing to save the court's and all parties' time and costs.

AND send a letter to the Judge by name, telling him/her that a third claim has been filed (claim number xxxxxx) and it is at N180 stage...and then add in the words you see that were written months ago, that you should find when you search for:

two claims? abuse of process consolidated
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi all,

In reference to this query, BW Legal have been sending 'final notice' regarding matters from 2016 to my parents address, where I have not lived since then.

It would appear as though that despite sending four claim forms to my current address, and performing numerous searches on my credit file, BW Legal are still sending correspondence to addresses they know I do not live at.

Either they are extremely lazy and incompetent (most probable), or they are deliberately trying to register a CCJ against my name in hope that I don't come across any paperwork.

I have a court date on December 6th, when 3 cases will be considered.I'm currently preparing my witness statement, Is this worth including as evidence of some sort of abuse of process? One point I intend to make is that the notice to keepers were not sent to the correct address because NTC were too lazy to obtain my updated details from the DVLA. I have repeatedly asked for evidence of DVLA look ups but this request has been ignored.

Send a Data Rectification Notice to the DPO at the PPC informing them of your address for service and requiring them to ERASE any old addresses.

They are incompetent, a judge said so today ...

Worth pointing out to the judge the BWLegal incompetence which must put in doubt their claim

Everything is automated templated spewing of paper. There is no human intervention until the issue gets much closer to a court case.

If I'm reading things correctly and the parking incident (2016) that is being chased via your parents' address has not been previously linked in any way to your cases going to court, BWL will be working off the address shown on your V5C provided by the DVLA at the time. The automated system will be oblivious to other cases linked to you.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
