    Since I have not got a witness statement from VCS yet do I mention this in my witness statement also?


    Sending the documents I work near the county court where the case will be held and I can take this there tomorrow at 2:30pm that should be ok, as it will be the 7th and it says for the court to receive the documents by then..
    If I was to hand it in as I did read in a reply on another thread by couponmad about handing in the statements rather than post.
    Also VCS shall I email or recorded post my witness statement to them? I would rather email that way I will have a record that it was done and I know they got it,




    I spoke to a person this morning entering the building about I noticed the sign has been removed and he said it's because theres a new company taking over soon, I didn't ask and I should of at the time if they had any problems with VCS but I should said oh right ok thanks...

    Send WS and evidence to the claimant by the method and to the address on the claim form. If they allow service by e-mail, this is fine. Do not use any form of signed for service if you post, just proof of posting from a post office counter - keep the receipt.

    Make the court file really easy to read, with a contents page and in a ring binder, with every page numbered, and the WS referring to the exhibits by number.

    Then put a sticker firmly attached to the front of the entire file, with the claim number, Defendant's name, and date and time of the hearing on it, so it can't be misfiled.

    I have completed the statement and the exhibits, numbered it all, I checked the details for the claimant to send documents to by email, as it's dcblegal that will be on there behalf in court they only have there address details in Runcorn to post to.
    So I have printed everything out including contents page as suggested to send, I will be dropping off the folder to the court after work today.
    I am right in saying not to post to VCS but the claimants solicitor and put there name, don't need to put case number on outside (I will do that when I take it to court today) but to them just name and address and post first class should be sufficient?
    I was going to ask, when I can edit whilst I am at work, I still have received no witness statement from them, do I mention this in my statement at the end what you think? But then again I have not sent it to them either as of yet.

    You send it to the claimant as listed on the claim form.

    I believe it is suggested to include it with your Skeleton Argument (if you're doing one) and send it to all parties a few days prior to the court hearing.
  • It has just come to my attention


    The claim form that I originally received "letter before claim" it states that the pcn details the date is wrong its 7 months earlier, so what they are taking me to court for to claim costs they have told the court in the particulars the wrong date
    Where as on the NTK it states a different date


    I have made ref to this in another point and put down due to the date etc claim is invalid and should be thrown out.




    I have just done a witness statement and contents page with all exhibits, costs I have not done as of yet.

    Bring up all anomalies like this , do the costs schedule (not order) as well and get everything to the court and the claimant asap , no ambushes on the day

    Everything you send to the court (file), you must also send (serve on) to the claimant.
