Hi all. I am back to update my thread.
I contacted the person in question (mentioned in my previous posts) last year and were advised to not counterclaim but to get our own claim in court against UKCPM if we wished to do so.
My husband and I then decided to get help with a defence for the court claim against my husband only as we were so busy with our newborn baby and did not have time to write our own defence. After we submitted a defence we waited for ages for the claim to be allocated to our local court. We finally received a Notice of Trial Date in February 2020 giving the Claimant until April to pay the court trial fee, failing which the claim was going to be struck off. We patiently waited for the date in question and rung the court the following day to be told that the Claimant did not pay the court fee. We immediately sent an email to the court referring to the Notice of Trial Date and requesting that the claim be struck out. Our hearing date at the time was 4 weeks away.
A few days later whilst we were waiting to hear from the court, we received a witness statement from Gladstone (signed by Jack Chapman) and then the following day a General Form of Judgment or Order was received from the Court ordering that the case is struck out due to non payment of court fee. My husband and I were so overjoyed as we did not have to go the court. Then 6 weeks later we received another Judgement or Order advising that the previous order was made in error and that a new hearing date will be advised. I can only presume that Gladstones did pay the court fee but somehow this was not registered on their system.
I am now reading through the threads and Jack Champman has come up time and time again. I have checked the signature on the WS that was sent to my husband and it is identical to the ones previously posted.
I am not sure when we will receive a new court date but our witness statement is half done. I now have to finish it off and I would like to post it here for comments if you don't mind please. Any help and advice would be greatly appreciated.

Thank you Coupon-Mad. Just to double check, I believe we need to submit WS at least 2 weeks before the hearing date? As we don't know the hearing date yet, shall we just get the WS ready and wait till we find out the new hearing date and then submit the WS two weeks before. I would not want Gladstones to come back with more arguments if we submit it too early.0

It is certainly a good idea to start work on preparing your Witness Statement and gathering evidence.
Although the courts often do specify WS and evidence to be filed 14 days before a hearing, it is not always the case. Some require it filed and served much earlier. It is important to read your hearing Notice carefully to ensure you don't miss whatever deadlines are given.4 -
