I've read the Newbies thread and loads of other threads. I keep seeing people say they received a letter before claim, and some action is needed, or they received a pretend letter before claim and they can ignore it.

I've received something and I'm not sure what it is. Please can people advise me if it's real or not?

If it is, I might have follow up questions.

    Yes. The clue is that it says "Letter Before Claim" in big at the top.

    It's real but GLADSTONES ARE SCAMMING YOU ADDING A FAKE £60

    They have included a new wheeze ....

    "The £60 is for time spent" <<<< THAT'S THE SCAM.

    The Protection of Freedom act (POFA2012) very clearly states ...

    "The claim contains a substantial charge additional to the parking charge which it is alleged the defendant contracted to pay, This additional charge is not recoverable under the protection of freedoms act 2012, Schedule 4 "

    Did you also receive proof of their claim, pictures etc etc.

    You need to rebut the claim requesting proof of the time spent that amounted to £60.

    Gladstones will ignore this and should the claim go to court, you can tell the judge they ignored you and that this is abuse of process and against the courts ruling about double recovery

    I have read the Newbies thread and I think I can find a template letter to send back to them. I just don't want to do the wrong thing so I might ask silly questions.

    Just so I'm clear - the next step is replying to them, is that right? I do read advice sometimes that says ignore them, but at this stage, a reply is required?

    You MUST respond to the letter. Pre action protocol (PAP) states they must prove their claim. As such Gladstones have failed the PAP

    1: Proof of the £60 claim
    2: Proof of their claim

    You send them one telling them to place it on hold whilst you SAR the claimant and seek debt management advice, plus proof of the claim

    They will refuse to do so

    Meanwhile you email a SAR to the DPO at the PPC and obtain all the documents and pictures and data about you and your vehicle attaching a copy of the V5C as proof of ID under the GDPR

    Awesome thank you. I'll draft the response tonight, hopefully I'll be able to figure out what I'm doing but I might post it in here for your review, if that's OK.

    This incident was back in November 2018 and I think it was Parking Eye but I genuinely don't remember. I don't remember where I was parked and why I got a ticket. Should I send the SAR to Parking Eye anyway, or is there any way I can find out who the PPC is?

    It will not be parking eye, they would not use the incompetent Gladstones.

  • So, a quick update.

    Following on from me receiving the Letter Before Claim, I read the Newbies thread again and I did the following.

    1. Emailed UKCPM with a SAR request. No response yet.
    2. Emailed Gladstones to tell them the SAR request had been made, I was seeking debt advice and to put my case on hold. They emailed back within 10 minutes to say they were refusing to do so but extended the PAP to 15th September.
    3. Emailed the landowner to ask for them to cancel the ticket. No response yet.
    4. Emailed my MP to complain about UKCPM and Gladstones. No response yet.

    Is this everything I need to do now?

    Lastly, I have a question about the possible next step. The Newbies thread suggests that a court claim is likely now and the next step, when it happens, is the acknowledgement of service. In my case, I genuinely don't remember the parking incident, so my defence will be quite difficult. Am I going to come unstuck because of this?
