Ah thank you.'Notice of the Proposed Allocation to the Small Claims Track' has now been received so the ball is rolling.

Emailed the solicitors again asking them, once again, how their charges are made up and how they came to £240.72 from the original charge of £60.

Once again a big thank you for all of the advise :-).

So BWLegal are ignoring you, that is just plain ignorance

So, you tell the judge BWL will not explain, let the judge ask them.

Be interesting to know what their stuttering excuse will be.
  • Email confirmations have been received for both emails so they cannot deny that they received them. This is why the keeper always makes contact via email. They can be no 'misunderstanding' about what has been asked/ said and when it was asked/ said.

Evidence has already been submitted for the case though. Keeper was unaware that the attempts to claim extra costs is against PoFA 2012. Can it be submitted in court? If not and the judge rules badly, how much is an appeal? Can't seem to find an answer on Gov website.

You will have your opportunity to speak. Do remember that BWL send new rookies to court, just cutting their teeth in the county court. It seems BWL do not fill them in about the scam

Yes there are bad judges but they can be just as bad for BWL

Go on, you rub BWlegal's nose into their scam

    Evidence gone in ?

If this has gone to small claims track your WS plus Exhibits plus costs schedule will be submitted in a few months time, so add in pofa issues into the bundle
  • Thank you. It was a reply stating that the keeper wasn't the driver and pointing out an ignored SAR. Keeper has never named the driver, but the PPC claims the landowner witnessed the vehicle being parked by the keeper, a neat trick considering there where a few miles away riding their motorcycle at the time lol.

As long as they get the chance to point out their unethical actions at court all should be well.

Being a total numpty with this kind of thing, aren't BW Legal legally obligated to respond to such an enquiry?

If you have an ongoing court case then the bargepole post about timelines, WS plus exhibits stage etc tells you what all parties involved should do and when

B W legal should follow court procedures, not play ping pong with you

You talked about evidence going in, meaning the court hearing is imminent and you have submitted the WS plus exhibits plus costs schedule already

Because they are not professionals, they prove that daily
  • Okay. I'll rephrase the question. Is a professional solicitors legally obliged to respond to quiries made via email lol.

Oh, and how much would a appeal potentially cost please?

What are you thinking about an appeal at this stage?
  • Just in case the evidence of double recovery and the blatant attempt to force the keeper to pay the court fees, to avoid court action is not allowed in court. It is grounds for dismissal.
