Reversed into on a carpark, go through insurance or not?

thanks in advance for any advice.

I was reversing out of a space on a carpark,.into the "road area". i had reversed out and was stationary about to move off forwards when a car in a space opposite my original space was reversing, they reversed straight into the side of my car. ( Huge dent in drivers side door of my car, barely any mark whatsoever on his bumper)

There was a witness but unfortunately he happened to be the drivers mate (gym carpark). He did say i came out first and was stationary. But I doubt I could rely on him as a witness.

I know im not at fault as im stationary, but the other driver just disputed it straight away, tried to make out we were both reversing and crashed into one another, which is not the case. Tried to get cctv footage but there are no cameras. He just said he couldn't see me lol.

The driver has offered to pay half the damages if I get it priced up privately.

Is it at all possible to win this through my insurance or am I better just biting the bullet and accepting half privately?

    Without any proof, it's going to be split liability.

    You'll probably win half through insurance, what both parties probably need to learn from this is to reverse into a parking space, that way when exiting both parties can see each other and less likely to collide and all the other aftermath that follows.

    if he "couldn't see you" how can he also claim you are reversing? Go through insurance sounds like quite a bit of damage to your car. If he reversed into the side of your car ie T-boned it then IMHO it should go in your favour. If back to back then 50/50
  • Is the fact that he's hit my driver door not prove my version of events?

    If we were both reversing he would have hit my rear end or the corner of my car not the side.

    I had already reversed into the road, ready to pull off forward when he decided to come out, hence a huge dent in my door.

    Go through insurance. I had a similar bump a few years ago and the damage cost £1600. You’ll be amazed how expensive a new door will be and the other party won’t want to be stumping up big money when he’s probably thinking “that’ll t-cut out for a couple of hundred quid”.

    Be warned that it’ll probably end up split liability though, so it will cost you. The insurance company won’t be interested in the forensic details of the damage. Just write an honest account with a diagram, deny liability and see what happens. The other guy might admit fault but if he doesn’t, it’ll be shared.

    Future reference, reverse in, drive out = more visablity.
  • Why are people saying about reversing into a bay.

    I have already reversed out into the road, then someone has reversed into the side of my car.

    If we had reversed at the same time he would of bumped my rear end not my drivers door.

    It probably will end up as 50/50 because that's easier for the insurance companies but the damage should show that you were stationary - if you were moving when he hit you, the damage would be spread along the side of your car.

    If you'd reversed in, you'd just have driven out forwards and been gone.
    If he'd reversed in, he'd have seen you were there and not pulled out.

    I would say go through the insurance.

    He'll be expecting a blow in job on your car and when you present him a bill for £££ or £,£££s to get it done right he'll renege.

    BUT, private land, no reliable witnesses. His word against yours....
