Can I appeal a stay of less than 6 minutes of I didn’t buy a ticket ?

    Certainly no Grace periods for obstructing an ambulance parking space. And, I fear, little sympathy from the Hospital, POPLA or the courts.

    But, it all depends upon what the PPC are claiming and what photographic evidence they have.
  • Well they have a photo of the car number plate entering an exiting and they are saying that he parked in an A and E drop off zone. Which I’m assuming must be a big no no.
    I can’t see this being appealable and really it’s a lesson to him. Though he’s old now and will make mistakes like this unfortunately.

    That doesn't sound like particularly good evidence. A photo of the car entering and exiting doesn't prove where he was parked.

    It turns out that he parked in the ambulance A and E drop off zone, amd actually he hadn’t seen a sign saying you could park there for 20 minutes after all. So it seems likely that that’s probably a no go area that needs to be clear for the ambulances. He wasn’t thinking as I had just been rushed them to A and E so he was just trying to park where the ambulances did their drop offs to find me. I think he’ll probably just have to pay it.
    What, even though a no parking sign means there was no contract and no cause of action? And the BPA CoP also requires a grace period as quoted already.
    Come on CM, we've had enough examples on here of PE issuing PCN's for de minimis overstays that it is clear they don't adhere to the CoP re grace periods. It is getting to the point where you can tell it is going to be a PE case even before the OP says so.
    Yes, but only de minimis overstays of 10+ minutes, not five, so I guessed it would be the Ambulance area and not quite as it seemed.

    Although it's well worth defending on the basis of no consideration flowing between the parties, no contract involved, prohibitive signs, no fair grace period, etc.

    You may appeal but it has to be in your Father's name, i.e. as if he sent the appeal. Nothing to stop you pointing him in the direction of the standard appeal in the NEWBIE sticky.

    As above, there is no I in this saga

    You can be the good Samaritan and help him, write the appeal etc on his behalf, but it's all done in his name, he has the legal responsibility, not you ( that is , unless you have power of attorney over his legal affairs ? )

    Dad needs to complain to the Hospital about this 5 minute PCN and unclear signs and get them to cancel it, laying it on thick about how vulnerable he is. P/Eye won't listen to mitigating circs but the NHS Trust must.
