I think the LIP rate is £19 per hour; which makes the sub total £361.

Do not worry about the total , it's a basis of what it has cost YOU , the judge will decide on the details and figures they will allow , which may mean some of them are reduced or struck out , but it's their decision , all you do is lay out the facts and prove your claims such as receipts , wageslips etc

If they limit them to what is usually allowed , sobeit , but they are unlikely to add figures if you have failed to do so , so if in doubt put them in , the worst they can do is say NO
  • Okay, thanks for that.  I haven't finished putting the evidence bundle together so I'm not sure of the exact weight for postage yet, but am I right in thinking I only need to bring the Schedule of Costs on the day I come to court?

Put everything into three bundles , including costs schedule , you cannot ambush in court

Claim postage costs for the one posted to the claimant , deliver the court bundle in person , take bundle 3 with you on the day
  • Oh ok - do I need to send the Claimant my Costs Schedule? Do I also need to send them evidence of costs? (I won't have a postage receipt until after I've submitted the parcel for delivery

Evidence of costs in court on the day , to the judge , but the costs schedule  claim goes in with all the bundles

I already told you , 3 bundles , one goes to the claimant , one to the court , one taken on the day

To give you some idea on ambush.
When I was in court recently helping someone the judge was shown an email sent to the claimant a week prior which offered a drop hands offer and asking about the fake £60. The claimant never replied to that. In court the rep was about to object but, we proved the email was sent.  The judge asked the rep if he knew of this email and he said no, his client had not told him.  This was now game set and match with judge saying to the rep, "it's not going well for you is it"
This happens a lot where the claimant fails to tell the rep the whole story.  The moral here is that if you have anything that has not been answered and you can prove you asked prior to the case, you can bring this up and that is not an ambush, even if the rep knows nothing about it
  • Love it! Although I don't think I've specifically asked a question that they havent answered. Tempting idea to send a similar offer though!   :)
