Hi, sorry for the delay it does not mention white lines or parking wholly inside baysm not crossing lines etc just the not causing obstruction. Unlike many parking signs I have seen online that do say within the marked parking bay and some actual show a diagram of a car parking over the lines.

The signage on the car park is the 'contract' to which the driver signs up to. If it doesn't have anything in it about white lines, that is a very powerful argument to put to POPLA.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No mention of bays or the lines of bays. Do MB mention parking outside of a bay in the NTK?

Hi no mention of parking outside bay on the NCP just

Vehicle was not parked in a designated parking area
Vehicle was parked causing an obstruction

I have already done POPLA & just said no obstruction was caused & I was parked In a Designated parking area - didn’t mention signs not stipulating within marked bay

But you can of course mention that at the comments stage when you see MB's evidence.

And if you lose, you just ignore them unless they try a small claim (no risk, as long as you don't miss court letters and deadlines and as long as you inform MB if you change your address within 6 years).

NO-ONE here is daft enough to actually PAY the likes of MB!

Right didn’t realise I could comment when MB had put their evidence to POPLA - I did upload a copy of the parking conditions when I put the POPLA appeal in though

This may not stand up but the sign doesn’t say parking in in A designated bay ie singular/one bay - just DESIGNATED BAYS

Then you need to re-read post #3 of the NEWBIES thread that tells you about the POPLA stages and what to do when. You missed the advice before you rushed in a (probably losing) POPLA appeal but you may as well be ready to try to focus POPLA's minds in your comments.

As CM has said you've probably rushed your POPLA appeal and maybe should have put it up on here for critique first.
Again you do have a chance to put in a strong rebuttal of their evidence when you get it. Their evidence photos of the vehicle will have to prove that it wasn't parked in a designated area and/or was causing an obstruction. I don't suppose you will have your own photos of the car in situ?

No as I didn’t get a ticket per se I can see from MBs photos the the car in front on the bay I am “overlapping “ cd easily pull forward into the space hence no obstruction
