NCP Ticket - Appeal Decision Not Received

Evening all,

Looking for a bit of advice and I apologise in advance if this has been requested elsewhere, but I have looked and didn't managed to uncover anything.

I received a NCP parking ticket at a railway station back in June and appealed the decision on the basis that I paid using the Dash app but an error occurred and I wasn't notified of this in time to prevent a keen warden from issuing a ticket...

Although I didn't hold much hope for the appeal, I tried any way and didn't hear anything back, until this week when I received that awful ZZPS letter requesting double the ticket charge...

I contacted NCP (I see now I shouldn't have, but panic ensued...) to tell them that I haven't received a decision on my appeal, only to be told an email of the appeal decision was sent to me 2 days after appeal submission, obviously upholding the ticket charge.

I've checked through my emails - nothing in spam, junk or bin, and have checked my filters and nothing would have prevented this email from being received, yet it didn't land with me...

I requested I get sent this again but was told they couldn't send it electronically and could only do it through the post... Again, now I see I've Syed right in to their hands, but I guess you live and learn... 🤦🏼!♀️

My question is - doesn't anyone know of any way I can get out of paying this grossly inflated fine?! Surely there's something in the fact I never received this email? They're appeal system is obviously hugely flawed - I knew it was a bad sign when I submitted the appeal and was given no reference number and told that no confirmation of this submission would be given...

Any help you can give would be very gratefully received!

    It is not a fine. It is an invoice for the damage they allege they suffered when the payment method they suggested failed. Hardy your fault. You do not need to pay them a penny unless a County Court Judge so orders. Given the circumstances this would be highly unlikely.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    It is not a fine.

    Follow the advice in the sticky thread for NEWBIES.

    You need to determine if railway byelaws apply as this will time out after six months if that is the case. If that is the case then you have the choice of ignoring or playing Q & A ping pong with them for six months.

    If byelaws don't apply then you need to chose them for a PoPLA code so that you can appeal. Having told them who was driving will make that harder but not impossible.

    Don't forget to complain to your MP about this unregulated scam.

    Does it say byelaws and fine anywhere on the paperwork or does it say it's a parking charge?

    I suspect I know the answer but it's best to check. The two things are extremely different.

    It wont say bye laws, NCP dont have any sites in their estate that are under railway bye laws

    It's definitely worth a try, but I don't think this will be quick and in the meantime I don't want any bailiffs showing up at my door!

    I'd be able to stomach the charge if I had the opportunity to pay the lower fee - what's really grating is the fact that they told me they issued an appeal decision via email but this couldn't have been sent because I never received it! It's completely unjust! Is there any way around this?!

    I'm dubious that's the case. I suspect you aren't reading it correctly but if it is correct then is there any chance we can see the wording that says that? Either host a copy of the ticket on a hosting site or copy out the wording that says penalty.

    If you host it on a site link to it by changing http to hxxp.

    Please double and triple check it actually uses the word penalty as NCP have never issued Penalty notices before.

    It won't.

    You do realise, NO CCJ IS LEFT, not even if you lost in court then paid? No CCJ remains, nothing affects your credit rating (and we win 99% of well defended cases here).

    Yes, by not paying it. This isn't a fine. Have yu seen their proof yet that they emailed a response? If not, press again then lodge a complaint using the complaint page on the BPA Trade Body website.

    There is no need to pay this, until a Judge says so, and no credit risk as long as you don't go moving house and not telling them, and missing court papers that are fairly simple to defend (well we find it fairly simple!).

    Do we assume your appeal blabbed who was driving, or not?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
