Parking Fine when i didn’t park!

Hi, In april 2018 my husband got a parking ticket from a private car park in plymouth. It had the photo of our car on a junction with us both in it. However in the night in question we were both at home. I know this because i have a text conversation btalking about my sisters hamster being missing and how I went down ti rescue it! Anyway, we ignored the letter, then got another. So i replied with details saying we were not there so this is obviously. lie and that if we were there why did we not see a full photo of our car exiting the car park rather than just a snapshot which could be at any junction as I know we werent there. We have had a fee letters since and one today saying our case went to court and we now need to pay £247.69 and have a ccj. We can pay in £40 a month installments!! Any advice please??

    So you ignored the letters from the parking company and the court papers?
    Is that correct ?

    Was this your vehicle on the pictures, or an ANPR missread?

    Who's car park was it?

    Don't pay in instalments, it wrecks your credit file. Pay in full within 28 days of the judgement and get a receipt.
  • Yes we ignored the letter as we thought it was a scam because we weren’t even there. It is a Britannia Parking carpark

    if you ignored the CCBC letter from Northampton you now have a CCJ and should pay off the full balance within one month in order to avoid it being on file for 6 years and trashing your credit rating

    If you cannot pay it off in full then contact the claimant and ask if they will agree to you paying on the drip and take it from their response.

    Given that it was not a scam, what do you want to do now?

    You can apply to have it set aside, but it will cost £255 and it is not certain whether a judge will agree to it, or you can ask the PPC to agree to a set aside by consent which will cost you £100 plus the court award.
    Again there is no certainty that the PPC will agree.
    You never know how far you can go until you go too far.

    There's no grounds for a set aside from what we have been told

    And the ccj won't be set aside by consent till it's paid in full
  • But we weren’t there! so it was a scam! I didn’t realise it would get this far as we never had a letter to tell us when it would be going to court to be able to challenge it? It’s really confusing when all people say is ignore these firms even if you do park illegally but we werent even there

    Earlier in your thread you told us that you had ignored the court correspondence??

    If you don't respond then it doesn't go to a hearing as you have discovered
