Registered keeper received a county court claim from Gladstones solicitors on behalf of UK car park management. Issue date on the form is 18/07/19. filed AOS on 22/07/19.
Background.
registered keeper do not recall a ticket on the vehicle for parking there. However, letters from UKCPM and Gladstones were sadly, stupidly ignored it. The only time vehicle Might have been in the parking lot listed in the claim form was when just parked behind the buildings while driver went to find out info on when the shops in front were going to open on a sunday. The whole area was empty as most businesses were closed. Driver basically walk over the store front to find out their opening times.
It is possibly someone who took the picture. However, investigating the address listed on the claim form to gather info. It revealed pictures to show a UKCP sign that is barely hanging straight up. This sign is like a trap. Could easily have been off the wall when d contravention occurred. Can pictures be posted here?
need help with defence as running out of time. Also does anyone have email address for Gladstones solicitors. to copy them in a request for all information relating to this claim.
Please all advice is most welcome and appreciated.

Everyone is asked to read up on this in the newbies FAQ thread near the top of the forum before starting a new thread
Go there now to get an understanding of the game you are now caught up in and how to deal with this
Post #2 there covers Court claims and how to deal with them right through to the hearing, together with near template defences you can crib from
Throughout here you are advised never to reveal who was driving
You need to edit your post to remove details of who was driving
Construct your draft defence and post it here for comments before sending it0 -
Edit your post #1, into driver and keeper, no "My , Me , Myself & I" should be used
Email a SAR to the DPO at Ukcpm asap to obtain all the documents and pictures and data about you and your vehicle attaching a copy of the claim form as proof of ID under the GDPR
Then start drafting your defence and post it below after reading the newbies sticky thread post 2 and reading other Gladstone's court case threads on here
Nobody on here will write it for you but they will give you advice and feedback to improve it0 -

That's ten days away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of [URL="https://forums.moneysavingexpert.com/discussion/4816822NEWBIES FAQ sticky thread[/URL] to find out exactly what to do with it.

Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -

Dear sir/Madam
I am writing to you in your capacity as data protection officer for your company - UK Car Park Management. I have reason to believe you hold personal data on myself as a vehicle I own and am the registered keeper for visit to a car parking site managed by your company. Such data is collected by your ANPR camera systems". It should be noted that contrary to article 13 of GDPR legislation no privacy information was provided to myself, the data subject, at the time of collection. I am therefore compelled into making this request for access to personal data pursuant to Article 15 of the General Data Protection Regulation which, as you will be aware, came into force on 25 May 2018.
The vehicle in question is a Vehicle Model with VRM:******
I would like you to be aware at the outset, that I anticipate a reply to my request within one month as required under Article 12, failing which I will be forwarding my inquiry with a letter of complaint to the Information Commissioners Office (ICO).
The following info is requested;
- ALL photos taken
- all letters/emails sent and received.
- all electronic data including automated decisions to generate letters, etc
- a close up of the sign on the day with the car parked/empty in the same view.
- all photos taken relating to this case, withholding none at all,
- and copies of the PCN and all letters sent.
This is a SAR but also an Objection to Processing.0 -
A 'close up of the sign...' is not personal data, and therefore cannot be retrieved via a Subject Access Request.
'All photos taken' appears in your list twice, as does 'all letters sent'.0 -
I have reason to believe you hold personal data [STRIKE]on myself as a vehicle I own and am the registered keeper[/STRIKE]
...... about me and a vehicle (VRM AB12CDE) for which I am the registered keeper.
Keep 'ownership' out of the equation. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you. Amended SAR as advised.
From the newbies thread, it says
As well as the SAR to the parking firm's Data Protection Officer (DPO), also write a letter - by email to Gladstones ......
but unfortunately their email cant be found.0 -
Gladstones email address is clearly displayed on the last line of every page on their website.0
-
Simply make up a name at a local doss house and name them as the driver. The scumco will go away and spend money and time chasing this fiction.
I know someone who has done this 30+ times and has never had a follow-up.
If you haven't got anything constructive to add, I suggest you don't.0
