Aire Street Leeds / Parking Eye - 16 minutes = £100

Gentleman
Posts: 16 Forumite

Hi,
I am new to the forum and as many others, I received a PCN of £100 for 16 min from Parking Eye Aire Street (Leeds), and I was looking for a bit of advice with regards to my appeal to POPLA, as I have already made my appeal to Parking Eye that was unsuccessful.
I have been reading different post since I received the PCN to try to have the best info related to my situation, but, to be honest, sometimes it is very hard to understand, so if you don’t mind I would like to have a second opinion from you to check if it is right or not.
After reading the “Newbies” post, I started the process appealing to Parking Eye;
1/ Stage 1: Initial appeal to Parking Eye.
“I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.
in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.
Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute remains the current address for service in the future.
Yours faithfully,”
Then, I received an email with their decision to my initial appeal; Unsuccessful. See below;
2/ Response from Parking Eye:
“We are writing to advise you that your recent appeal has been unsuccessful and that you have now reached the end of our internal appeals procedure. This is because you have not provided sufficient evidence to show that you did not break the terms and conditions on the signage. We are fully compliant with British Parking Association regulations on signage, and confirm that there is adequate signage at this site that is visible, appropriately located, clear and legible.”
And finally (hope so), I am continuing with the Stage 2;
3/ Stage 2: Appeal to POPLA:
Please see below a link to download the appeal to POPLA (pdf), as it´s including some images.

Any help would be appreciated as I would to be as “accurate” as possible to be successful.
Thank you very much in advance
Kind regards

Have you read this Good Sir?

Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0 -

Good afternoon "The Deep",
Thank you very much for your early response.
Notifying the incident to my MP is something that I will definetly consider in the near future.
However, I am cureently concerned about claiming the ticket to PoPLA, as I want it to get dismissed. Therefore, if you have any comments about the document in the link, they would be much appreciated.
Thanks once again for taking your time in responding me.

I doubt that anyone here will spend their time reading a 13 page popla appeal
Personally, I will not click on unknown links or download unknown files from unknown sources, that is how people get infected, hacked or activate Trojans
Just a thought0 -
PoPLA are far from impartial, win or lose, PE are still triyng to scam you.You never know how far you can go until you go too far.0

Hello guys,
I am still looking for some advice,
I submitted my appeal to POPLA, and I have just received ParkingEyes´s evidences, and POPLA is asking me to provide any comments to their evidence, and I only have 7 days to do it.
I have been looking other POPLA rebuttal as “Coupon-mad” is mentioning in other posts, but to be honest, my level of English is not good enough to understand everything and also to write goods comments to their evidence. So, I was wondering if any of you could help me to write it properly or at least give me some clues.
You can find below a Google Drive link with their evidence (I removed some non-useful pages), so you would be able to check it, and give me your opinion and comments. I know that some people don´t trust external link as they can have virus and infect your computer, but this is link is from my personal account. If you don´t trust, what can I do to send you a pdf with their evidences?

Also, I checked a previous post with similar situation as mine,
2forums.moneysavingexpert.com/showthread.php?t=5617801&highlight=andreasa&page=2#topofpage"
But I believe is slightly different with regards to the evidences. So, I am a bit lost and I am not sure how to write my comments.
Any help you can offer would be greatly appreciated
Thank you in advance0 -
Find any issues in their evidence pack like contract issues , signage discrepancies , ntk errors , failures in law etc
Also check for any omissions that help your case
Also check for any evidence that proves your case
Write your rebuttal in notepad , keeping under 2000 characters (not words) and copy and paste it below , because nobody will write it for you
Read previous rebuttals and adapt them0 -
