Pls Help - Court Claim Received / Horizon/Gladstones / Office car park

    As this is meant to be from Horizon, but is an exact match for other Gladstones WS they write for UKCPM (a completely different firm) then you can also say in court that this WS was:

    - served very late indeed and was found in your email spam folder and no doubt reached the court a week late;
    - not actually written by the person whose facsimile signature appears at the end, if that person even exists, given that they have not turned up to court to be questioned and just sent a rep who can't be cross examined;
    - not actually from anyone who was a 'witness' in the true sense;
    - one of two separate claims issued instead of advancing the case as one claim;
    - reported to the SRA by you this week, as it is a matching template for (allegedly false) ''witness statements'' from completely different parking firms, such as UKCPM and it is currently part of an investigation into Gladstones.

    Do the same as this person has just done, an email complaint to the SRA attaching that WS and tell them Gladstones appear to have used the witness statement template they use for UKCPM, yet his is a Horizon Parking claim, so it is clear that the alleged signatory had no hand in it and as a WS it fails to meet the professional level that one expects from an SRA member solicitor who cannot just employ statement writers and slap facsimile signatures on the bottom then email them off late to consumers, with the parking firm employee (if they even exist) possibly never even seeing it, and certainly it is not their own words:

    Please read the recent posts there and email the SRA as they are investigating Gs right now, this month.  Be quick!  Also tell the SRA that Gladstones filed a second claim against you, for a car you do not and have never owned, and you believe this was their own internal data handling error but again, proof of a lack of due regard for the data of the victim subjects of their meritless roboclaims.

    I'm completely flabbergasted this morning - as today in the post i have received ANOTHER claim form (Gladstones/Horizon for the same parking spot) - yet for a car i have never even owned of never mind driven!!

    Do you still have two, this thread is long so I can't tell if these are not consolidated into one hearing.  Did you report Horizon to the ICO for divulging someone else's data (VRM and parking event dates/details of where that car was) in that other scam claim?  

    If not, do that online now as well - ICO complaint about Horizon.  Revenge!

    • the two claims were consolidated by at the Local Court - i guess the DDJ had a more practical approach!
    • turns out that the 2nd Car was a Courtesy Car for an accident repair at the time - not a car i ever owned but the hire company likey passed on my details like a hot potato as soon as Horizon sent the the ticket/NTK
    • so it was 1 ticket on the Courtesy car and a few on the main car, but now all under one case at Local CC
    I will note the points on the "Copy/Pasted" fake witness statement from Gs and mention to the Judge 
    I will also write the complaint now to SRA today about Gs conduct

    My hearing is Friday so its final countdown, and i appreciate EVERYONE's help!

    I have done the SRA Complaint and mentioned :-
    • Their misconduct of adding the £70 when they know that it contravenes CRA 2015 & POFA 2012
    • Their misconduct of then knowingly proceeding with the Claim, knowing all too well that their own cases are being thrown out on an abuse of process
    • The late filing of their WS and unproffessionalism therein, giving me no time to prepare for the hearing
    • The Fake copied Witness statement! The possible forged signature! and the gross misconduct this represents!
    • The evidence this represents for the "Robo-Claim" business model & practise

    Just had an email from the Court...
    Peeved off isnt really the word..
    trying to request a Judge to go over my WS/Exhibits and the Supplemental WS and rule by paper as this is getting nuts now

    The hearing in the above matter on the XX March 2020 is provisionally listed and unfortunately the Court does not have a Judge available to deal with the matter. The hearing on the XX March has therefore been vacated and will be relisted as soon as possible. If you have any dates for the next 6 months when you will not be able to attend Court please send them to us within the next 14 days and the Court will take account of them when relisting the matter. If you need to discuss the matter with the Court please contact us on xxxxxx.

    yeh gonna follow it through with the CC and try to get my case bundle under a Judge’s nose (any Judge will do!) for a strike out. My hope is that your Supplementary WS with all the recent cases struck out on Abuse of process will allow the Judge to swiftly tear up my case and be done with it - as they clearly didn’t wasn’t seen as important enough to get a DDJ allocated this week!

    i’ll post my redacted SRA letter tomorrow for assisting anyone like i did with Claimant WS

    will keep in touch on the SRA replies and post any update from my complaint too

    My plan was to do this after i had won, proved the abuse of process - and could print the result, laminate, frame, decorate with stars and glitter and then slap it on my MPs Desk and say "sort it"

    Updates from me

    - had a reply from my (new) MP asking “if I followed the appeal process” in reply to my complaint, and to give evidence of this ....(!) 
    - SRA replied and said it’s been added to an existing investigation and I won’t hear further from them on the matter
    - had a new Court Date for July but not sure what will happen now with COVID-19 situation as we could still be in lockdown

    can i ask for a paper decision by a judge? What are my rights?

    it has always been the case that you can have it heard "on papers" , so you can inform the court and the claimant of this at say 17 days before any hearing , so plenty of time for that decision  , perhaps 3 months or more before you decide to cross that particular bridge
