Driveway issue

We live off a private road which has shared access for 5 properties and there is a 6th property which has pedestrian access only to our road and has its own separate driveway.
The owners of the 6th property have created another driveway from their property onto our private road with the intention of using it as access to their property. Planning states they have no vehicular access. He has applied for retrospective planning which should be decided on the 22/08/19
The council are saying they only deal with the planning for the driveway and any access issues we have are a civil matter. Does anyone know how we go about getting the ball rolling?

Fence? Even a chain strung across where they would access your road as long as its attached on the private road property.

I would start by putting it in writing very clearly (but politely) stating that they do not have the right to vehicular access over the road, only on foot, so you are confused as to why they have built a driveway into this private road.

Perhaps it's better having an extra drive on to the road, otherwise they would have to park on the road. also they should now be jointly responsible for the unadopted roads upkeep.0

What a great way to start a war with a neighbour !!!!!!!!!
Then when anyone wants to sell you have to declare a neighbour dispute.
Is it really worth it ?
Will one more houses driveway cause the end of the world ?
First, why not tea and biscuits, and offer to give them legal access if they pay all the costs and agree to a 6th share of the road maintenance.
If they refuse, then the only real option is the legal one, and solicitors arn't cheap.
Dont be tempted as some advocate about blocking the drive with chains, bollards or old cars, as your then moving into the realms of harassment, disputes, police involvement and a world of pain and stress.
Watch a few neighbours from hell programmes to see what people will do in your type of situation, and the costs (not just money) involved.0 -

I presume that it is a private road that the users of pay to maintain or will pay to repair.? Are these obligations specified in your deeds?
You could approach the 6th property owner to ask if they expect to become jointly responsible for the maintenance of the road they may use?
Or just install the bollard at the end of the road.Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. Most people are incapable of forming such opinions.0 -

I take it you've never had a full blown neighbour war ???? I have, and ended up moving to get away from it (before you had to declare them) and i say within reason, avoid them like the plaque.
Deny them use, and do as you say and the road may suddenly start to be used as a fly tip or bottles may get mysteriously broken on it.0
