selling food past sell by date

Not sure where this goes..sorry

Went into Tescos tonite and bought 2 packs of prepared salad,They were
£1.49 each or 2 for £2.

THE DATE ON ONE PACK WAS BEST BEFORE 04 JUNE BUT THE OTHER PACK WAS BEST BEFORE 01 JUNE.
I saw a manager and told him as it would be no good once i left the store,he took it from me instantly and just said oops sorry that should not be there you will have to get another pack.

I did expect a bit more gratitude l;ike have 2 packls free and save tesco from ANOTHER huge fine.

I am just wondering what were my rights (if any) and what might i have expected for bringing this to his attention and not trading standards.

    I've found this quite a problem with Tesco, but it's not always their fault. Customers will rummage to find the best dates - I do it - and not necessarily put them back in the right order - I manage that, though. I find the counter/shelf staff are always quite grateful. But if the best by date is "today", then they will put it back on the shelf with a "reduced" sticker on. They've never been grateful enough to give me freebies though!

    If it's "Best Before" you can sell it after the date. If it's "Use By" it is illegal to sell it.

    Maybe you should have told this to the guy at the time? If he were a mind reader, then he'd probably be on the TV, rather than working for Tesco?

    Although, dare I say, it's just a salad......:confused:

    With respect, none of us are forced to shop at Tesco?

    I don't think Tesco are any better or worse than any other major supermarket and errors will happen.

    Pointing out this error comes under the 'these things sometimes happen/being helpful' category in my mind.

    Please don't be offended, I'm not saying you are wrong to feel the way you do, but I do think that people in general these days are too quick to expect some sort of recompense for the simplest of things.

    My wife use to work at Safeway on the Deli. She has been told in the past to put new sell by date on items even though they are out of date, she refused to do it.

    We all obviously have different opinions about things, that's what makes for an interesting society. If we all agreed, then Martin's chat forum would most likely collapse ;) .

    I think perhaps that whilst I would like things to be perfect, they invariably never are....and this is because of a multitude of reasons.

    If I thought that a supermarket was deliberately selling shoddy or out of date goods then that is obviously a matter for concern. However, I believe that because the human race is falible, then mistakes will happen.

    Your example of M&S is not my experience incidentally, I have had to return food because of similar date issues AND because the date was obviously incorrect to start with as the food had mould on it.

    There was a documentary on tv a while ago about M&S food which showed where the food was made (same company that supplied other stores - same food/different label).

    So to me, it read more that the OP was less concerned about the issue happening in the first place and seemed more concerned about what he could've/should've got out of the situation.

    As mentioned already, we all look at things differently. To me, the OP's opinion that he perhaps should have gained out of the situation was more of an issue than the original matter of an out of date date.

    You have posted about your unhappiness with our society at the moment.....I agree with some of your points although I would have said that the OP's attitude was more indicative of a downward spiralling society than a date error by Tesco.

    I do fear we are only a step away from the American 'sueing' culture. That's a subject for another thread though. ;)

    Very well put peterbaker, tescos are slapdash on any given day you can find errors in their stores and they would lose points etc if it were known to the 'higher ups' so yes not for 'gain' as such but hte op should have been shown more gratitude for pointing up this error.

    I am still waiting for a stisfactory reply to my complaint about a faulty tin and in the general run of things I am not a compaliner at all ever but I am now thinking that I should have taken the tin to trading standards because despite having written to the MD they are still not recognising that they are ulimately responsible for seling the tin to me and they should take up the rest with the mnaufacturer. I was not after compensation, merely pointing out there was a ptentially dangerous fault with the tin.

    Having had no compensation does not bother me but they have given the scant standard appology and now it has just come to mind not even offered the paultry refuned of the cost of the tin of beans!!!!

    The original poster's language was a little bit loose. However you have wrongly inferred that the OP was seeking to gain personally, and from there gone on to suggest the old cliche that we are becoming a nation of complainers.

    Again, difference in interpretation. I don't believe I 'inferred' anything tbh. The OP states what the situation was ....then asked his question about his rights. I don't intend to get into a discussion about our society's standards as I don't believe that was what the OP was about.

    As for the 'nation of complainers' comment, that's not what I said or suggested. My point was that more and more people these days tend to expect some sort of sweetener any time they are inconvenienced, no matter how slightly and complain accordingly.
