Parkingeye overstay - Mountbatten Plymouth

Hey guys


Apologies for the thread.


Driver overstayed a 40min max stay carpark by 21 min, not sure if I could still argue graceperiods or not. Is it still worth appealing this?

    there are two grace periods, one before the period of parking, plus one to leave afterwards , the BPA CoP clause 13 explains them all , download it and read it

    the NEWBIES thread has the blue text template letter to send, unaltered , the KEEPER appeals on the PE website with it, as keeper , no blabbing about who was driving

    check if the NTK fails POFA or not too

    and complain to your MP as nine times out of ten these tickets are scams.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. .
    You never know how far you can go until you go too far.

    I have done a fair bit of reading today lol. Could only find someone mention 10 min either side for grace periods so was worried they might get me on a technicality as we're a minute over that. Could I argue observation period on top of this? BPA CoP dont actually state how long a grace period is supposed to be..



    They did have a section on POFA 2012 so not a golden ticket unfortunately (had one last time I was here for fistral)

    You need to check whether byelaws apply to parking on that site. Sounds like a naval/harbour/port area.

    If they do, come back for more advice in that particular context.

    I wouldn't hold your breath, neither does crossing fingers or anything else for that matter help. Your appeal will be rejected.

    It's at POPLA this can be won, and if this is a site covered by byelaws that will be an important strand to your appeal provided you have not revealed the identification of the driver in your appeal to PE.
