Parked in Mother & Baby Bay

Hi,


Family member parked car in mother and baby bay - (with 2 kids - 3yr and 6 weeks). Received a charge notice from UKPC for "Parked displaying a permit that is not valid for site" There is no permit displayed in the vehicle, and was clearly parked in baby bay - so think its because the warden assumed in error it was a Blue Badge space? Have called the retail shops and told "we have no involvement with parking , cant help"

The vehicle was "first seen" and "ticket issued" at the exact same time.


Have tracked down the Retail Park management company and emailed, providing details, asking for charge to be cancelled. Yet to hear back.
The charge has the wrong VRN on it (i instead of 1) assume that wont make any difference.





Q: Having read the newbie examples, I am going to wait for NTK, is that the right approach?
Assuming UKPC can get the keeper details from DVLA ?

I note that UKPC doesnt have a very good reputation - and their appeals page does not give a number to contact them on.

    Why should you want to telephone them? All in writing, judges love paper trails.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    I'm going to assume that as you used the word "warden", then you received a windscreen ticket.
    Yes, in that case, you wait for a NtK to arrive.
    You then need to send a SAR request to the data controller of UKPC, ask for ALL photographic evidence.
    If they are suggesting that you have parked in a permit only space, then they will need to provide photographic evidence that you are in such a space.
    If not, then you go to appeal, as they will not be able to prove prima facie.
    A pic of the signage at the actual site, in the meantime, giving the parking conditions t & c's, would be useful.
  • If this was a windscreen ticket send the BLUE NEWBIES appeal template as KEEPER on day 26 giving them the opportunity of forgetting to get details from DVLA.

    If they do access your data consider sending a LOC for £500 for obtaining your data without just cause.

    If a NTD was issued then send the blue appeal template around day 26 as per post 1 of the NEWBIES. Don't wait for the NTK, but don't miss the appeal deadline.

    If no NTD left then you already have the NTK so send the appeal now.

    Get pics of the site and signage asap.

    Send the SAR asap.

    Complain to your MP about this unregulated scam.

    What you called a "warden" UKPC call a "Profit Centre" that is the main reason that this muppet has blindly given a charge thinking his bonus has just been upped x one. The error in the vrn is thought to be part of the scam to get the driver to appeal early thinking that will void the charge but of course it is really trying to get the driver identified.


    All these little games are in play because you are dealing with twisted greedy scammers and yes you are right UKPC have been caught out numerous times.


    Follow Fruitcake's advice, don't phone anyone, UKPC have at lease three false pick up PO boxes to throw you off the scent so a phonecall won't help you, in fact you are more likely to drop yourself in it.


    Get your own photo's ASAP, their photos, assuming they haven't doctored them, will prove the driver was in the clear anyway.

    If UKPC were daft enough to take this to court, imo they would crash and burn.

    If this happens read up on a counter claim for vexatious litigation, infringement of personal date, and harassment. Alternatively, familiarise yourself with CPR27.14(2)(g) costs for unreasonable behaviour.
    You never know how far you can go until you go too far.

    NTD = Notice to driver ? is that the windscreen ticket?
    NTK= to keeper - that will show up eventually at registered address I assume?


    I should send the Blue response around day 26, and ignore the 14 day discount date?


    At what stage do I send the SAR.


    I've received no documents other than the screen ticket since this event happened on Aug 2nd so letter would be sent dated 23/8 since the 26th is a Bank Holiday.

    Send a SAR when they seriously threaten court. Send the blue template on day 26. You don't want to pay anything.

    NTD = windscreen ticket.

    Send the appeal at day 26 = UKPC are likely to forget about asking DVLA for keeper data within the time scales set out in law.

    No details from DVLA = no keeper liability. Also = no NTK will be sent.

    If they DO request keeper details (after having already received a response to the NTD) then that's a GDPR breach as they had no reasonable right to seek keeper details.

    Ignore the 14 day early payment bribe ... why pay (e.g) £60 when you'll end up paying £0 by following the advice here?
