  • It's a gamble and unfortunate. Been there, got the T-shirt and paid the price. Hope it works out ok.
Things that are differerent: draw & drawer, brought & bought, loose & lose, dose & does, payed & paid

They'll pursue the quickest, easiest and most cost-effective route (for them) which will be 50:50 if the other party stands by her account. The fact that it's the same insurer for both cars perhaps makes it even less likely they'll care because they'll be paying out either way.

[cynic mode]With 50/50 they also potentially get to remove no-claims discount from 2 drivers instead of one for the next several years.[/cynic mode]

Remove them for several years? If I'm found liable my no claims is halved as stated in my policy and as far as I was aware they then build back up every year there is no accident as they have done before. Why would theh remove them for several years?

That was exactly my first thought

You mean all the NCD you've lost will be reinstated within a single year? If not then it'll be several years before you're back to where you were.

I'm afraid you're working on the assumption that the insurer will be at all bothered about the details. They won't care about the forensic details of the dents. They'll pursue the quickest, easiest and most cost-effective route (for them) which will be 50:50 if the other party stands by her account. The fact that it's the same insurer for both cars perhaps makes it even less likely they'll care because they'll be paying out either way.

Correct, their account won't be admissable.

    No.

In fact they will likely pay out less on a 50/50 than finding liability with one, as they would have to pay 100% of the OP's claim and the other sides also.

The difference would be the excess. Either way the insurance company is paying the damages to all vehicles as we are both insured via the same insurance. The only difference to finding one of us liable is the loss of the excess from the side which wasnt found liable. Talking £200.

I'm almost certain she is liable as she has reversed clearly minus checking her mirrors however it is now with the insurers and after admitting liability at the scene she is now denying it.

Did you take a photo of the scene with your mobile phone?

Another case of someone asking for advice , ignoring that advice and then arguing the toss.
The best you can hope for is 50/50 .
Depending on your current NCD it could take several years to get back to where you were.
If you had 5 years NCD you would lose 2 years making 3 years but as they only count a max. of 5 years then if you had 10 years NCD you would also drop down to 3 years.

Have you read the whole thread, the OP has accepted the advice and sent off all details. I dont agree that 50/50 is the best she can hope for, that may be the end result of course
