Unpaid Direct Debit for M&S Credit Card (Charged £12.00)

I need some advice.

My M&S credit card payment via direct debit is on 1st August.
And I deposited the correct amount on 1st August in the afternoon.

Before I deposited the amount into my M&S current account, it had appeared the unpaid direct debit in my current account.

This has not happened in my HSBC credit card account and previously.
Can I make a complaint about this?

In general you need to have the correct amount in your account at the beginning of the day I think the afternoon is too late

The direct debit payment is 1st August. Is not 31st July.

For HSBC credit card payment direct debit via HSBC current account, the date is 1st August before 11.59pm.
  • Direct Debits can be taken at any time of the day.

The funds should have been in there at least 24 hours before.

Understand. Is there any way to complain?

When in the afternoon did you make your deposit?

The M&S terms are clear. So if you deposited sufficient money for all your payments by 3:30pm, you have a case for complaint with M&S. If you didn't, you can complain to yourself.
If you ask us to make payments on a particular day, we’ll check you have enough money in your account to make them at the start of that day. Unless it’s a weekend or public holiday we’ll check again at:

    • 1.30pm for cheque payments; and
    3.30pm for all other payments.

If we’re able to make some, but not all, of the payments, we’ll pay cheques first and then Direct Debits and standing orders and, if there’s more than one, we’ll start with the smallest payment. Any payments that we can’t make will be returned unpaid.

Oh, so M&S Terms stated 3.30pm which is different from HSBC 11.59pm.

Can I know where did you find the M&S Term about 3.30pm? Thanks.
