NCP Cardiff

Hi, new to the forum hope you can help.
Just got a ticket from NCP car park (Cardiff Adam St)

After parking we attempted to pay, this is how this car park has always worked. Park first pay later. But some how they have changed it to standard pay and display (ie estimate how long you want to stay and buy ticket)
So we were really confused when returning to the ticket machine, it was asking us how long we want to stay. So realising thing had change, we just bought a ticket (which I still have) for the amount we estimated we had been there. As not to leave without paying.

Also there was a sign, which read as follows (also have picture of sign)

"The way you pay for parking here is changing
From (there should have been a date here, but it was blank)
We will be installing ANPR cameras and up grading our pay machines.
You will need to pay after you've parked.
To do this you will need your vehicle registration"

So as far as I'm concerned I paid in good faith, and the sign with no date is misleading.

    Windscreen ticket or a postal notice (you never said) ?

    If it's a postal notice, how many days between the incident date and the letter arriving ?

    What is the actual contravention ?

    Not paid enough time ?

    Incorrect VRM details ?

    Overstay ?

    Take pictures of all the signs, especially the one with the missing info, but any others too

    Parked on 1st July 2019, had ticket on 3rd August 2019
    Contravention : parked longer than paid for

    So it failed the 14 day keeper test under POFA, so no keeper liability

    Appeal as keeper using the blue text template from the newbies faq sticky thread near the top of the forum

    No blabbing about who was driving

    It is doubtful that either NCP or PoPLA will cancel this. IMO you would fare better by letting them take you to court. Where a sign is ambiguous or t unclear, the law is likely to smile on you.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    As long as the Driver is not revealed, popla will kill this off on appeal
