Hi everyone,
First-time poster here. I've read through the pinned post and linked threads and still aren't 100% sure what is best to do (a reflection on me, not the posts, I promise!!) and wondered if I could get some advice.
I've had parking fines issued from 3 motorway service stations operated by ParkingEye. I studiously ignored them acting on advice I'd received from a colleague who assured me they would eventually just go away.
Today I received a "Letter before county court claim" for two of the three (I'm expecting the third soon as it was a later 'offence').
Essentially, in all three cases, the driver was doing a long, late drive and pulled over for a couple of hours' sleep when they could feel themselves struggling to keep my eyes open on the road. Those couple of hours' sleep turned into 4-5 hours sleep and as such they overstayed the 2 hour limit on these car parks.
Is there any approach I can take that will get these fines cancelled as I feel £100 per fine is obscene given the driver didn't cause the company any arguable loss insomuch as there were literally hundreds of empty parking spaces so they weren't being denied extra custom!

If you have read the newbies thread then you will know the importance of not revealing the driver
Edit your post to remove details of who was driving
If you have used your real name in your post and as your forum name then also edit that from your post and ask MSE to change it to something anonymous
The ppcs monitor this forum and can use posts in your thread against you in Court
It's now too late to appeal these.
Read up on court claims in #2 of the faq0 -
Your colleague is a p*llock, tell him to pay them due to giving you stupid legal advice
Tell him to google the name of Barry Beavis too
That ruling also prevents you from complaining about no loss
You need to try to settle these out of court, with enforcement at parking eye
Or take your chances in court and pay in full promptly if you lose
Those are your 2 choices, but they will issue court claims soon IMHO
There is nothing you can do to get them cancelled apart from complain direct to the MSA operator0 -

Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0 -
