Ppi on store card

Options
Hi everyone, posted yesterday but can't find it anywhere. Anyway here goes, I responded to an FB advert re a FREE check with Fast Track Claims regarding PPI. I clicked on the store card I thought I had it with but it turns out it was with another store covered by Santander and FTC emailed me to tell me. They then sent out paperwork to fill in which I didn't respond to. Santander then contacted me to initially reject my claim so I filled in 3 lots of paperwork (2 identical because they said they hadn't received the first lot. Eventually my claim was upheld, they made an offer which I accepted a week ago. Yesterday I received paperwork from FTC saying how much Santander were offering and to sign enclosed paperwork. Rang them up and said I hadn't given them permission to act on my behalf but they said they would be collecting a fee from me. They also said that because I hadn't contacted them they "assumed" I wanted them to go ahead.I said I wasn't paying then they started threatening me with debt collectors. How do I handle this? TIA

Ask them to supply you with copies of any agreements you entered in to and to confirm how, if they don’t back down complain to them and await their final response, if that doesn’t work go to the Financial Ombudsman Service as they can now consider complaints against CMCs... this is assuming they don’t supply sufficient evidence that you DID agree to their services, in which case you pay

OP's third identical post about this...
  • I did ask for proof that I'd entered into an agreement with them a week ago and so far have not received a response. Today I received a "courtesy call" from FTC saying they were looking into my complaint but that I would have to pay their fees until they had made there decision. Do I or do I not

So, if they haven't supplied you with a copy, you make a formal complaint to them in writing, post via first class, ask fora a posting receipt, stating you have asked for a copy of your contract which they have not provided. Mengion any previous times you have asked for this. Also tell them that if your complaint is not dealt with in a satisfactory and timely manner that you will be forwarding your complaint to the Financial Ombudsman.
They need to supply you with proof you agreed for them to act for you.
If they do supply you with proof, you will have to pay them.

They have eight weeks to respond. If they do not, you complain to the Financial ombudsmen

  • Well I do have a "Letter of Authority" with my details typewritten on it and my signature on the bottom. The only signature I made was an e signature giving them permission to check if I had ppi. I have never exchanged paperwork with this Cmc. Does this mean I'll have to pay? I suppose they'll argue I signed to allow them to claim on my behalf, I know I didn't. Trouble is it's going to end up costing me more in the charges they slap on
  • Yes I know I was stupid. Just had a thought. The guy I spoke to initially said because they hadn't heard from me they assumed I wanted them to go ahead with the claim, now they're saying they have a signed letter of authority from me. Can't be both surely

If you haven't complained to them yet, Then you need to complain in writing to let them respond.
I would also, if I were you, phone the FOS and ask their advice.
Is this signature on the letterbox authority yours?
