Unknown CCJ in Dads name, on MY Experian Credit Report

    Thanks everyone. The CCJ just lists my dad's first name (which is my middle name) and the address we both live at. Hopefully it's just an error that can be removed, especially as there is no date published with this CCJ.

    I've checked with Equifax (where it doesn't look to be on there) and TransUnion (where they don't have enough information to build my report yet, which would make sense as I've not had much credit).

    So assuming it only appears on Experian, I should...
    1. Contact Experian to explain this error (I assume I don't need to request another full Experian report as I have it via MSE Credit Club)

    2. Contact Equifax and TransUnion to make sure it's not on there (when this has been fixed)

    Do I need to do anything else?

    Yes you need to check and contact the CRA's where it is showing and ask them to remove it

    There is nothing to "explain" here as the information on your report is factually incorrect and that is all that matters - formally complain to all three CRAs on the grounds that it is not your information. Focus on Experian since the CCJ is listed there, but make sure to confirm that it is NOT present on your other files by getting access to your reports - the CRAs are obliged to provide your statutory report when requested. I would get your data directly from the CRAs here - although it is the same info as obtained from MSE credit club, it is better to get it directly from the source IMO. You can mention that your father has the same name as you as the reason why it has been mis-attributed, but the complaint should focus on the fact that another person's information (doesn't matter who at the end of the day) is listed on your file and must be removed.

    Phoned Experian earlier and they sent me this. Thoughts?

    I have checked the details we hold with the Registry Trust website and confirm they do match.

    If this information is incorrect, you’ll need to contact the court directly to amend this. Once the court amends the record, they’ll let Registry Trust know, who’ll then inform us; this will take approximately 14 days.

    We can then amend the judgment once we receive consent from either the court or Registry Trust, as the details we hold will then reflect their public records.

    It’s the Registry Trust that you need to contact. I have found myself in the same position and it’s them that distribute the information to the CRAs. Once things have been amended with the Registry Trust, your credit files with the agencies will update

    I emailed registry trust and it seems they're passing the buck. I'll now contact the court as it seems like the only common advice from Experian and Registry Trust. Pasting the reply below to maintain this thread [I've removed certain details in the square brackets]:

    My understanding of your enquiry is that you have a county court judgment appearing on your credit file which does not belong to you.



    what Registry Trust do

    Registry Trust Ltd operates the Register of Judgments, Orders and Fines under contract to the Ministry of Justice. By law, Registry Trust Ltd are not allowed to make unauthorised changes by adding to, removing or altering the information held on the public Register. Nor are we allowed to alter the information passed to credit reference agencies unless instructed to do so by the court.



    Registry Trust do have a legal obligation to act upon the instruction of the court to update or remove a judgment as and when it is requested.



    what details are held on the Register

    All the information that is included in a judgment registration has been provided by the claimant. That information is normally the name (and from April 2006 the date of birth, where known) and address of the defendant; the court and case number; the date and amount of the judgment. If the court tells us that the debt has been paid, we also record that information.



    how we have looked in to your enquiry

    In view of your comments we have checked our records and can see that we were notified by Northampton County Court Business Centre of a judgment dated 20th August 2014 against the name of Mr Gerard Brown [Gerard is my middle name], at the address of [removed] for the amount of [removed]. No date of birth was provided at this time and therefore has not been included in the judgment data.



    Unlike a credit reference agency, the public Register itself is simply a list of judgments issued by the county courts. Registry Trust do not link judgments to individual names and addresses, this is however, carried out by the credit reference agencies upon receipt varying information one of which is judgment information supplied by Registry Trust Ltd.



    next steps

    If you believe a specific credit reference agency is reflecting the judgment under case number [removed] against you on your credit report incorrectly, you will need to contact them and request that they remove the incorrect information from your credit file. This is not something I can do for you.



    You can also ask the credit reference agency to add something called a ‘Notice of Correction’ to your credit file. A Notice of Correction is a short statement to explain the circumstances surrounding an entry on your credit file. The credit reference agency can decide not to publish your notice if they feel it is incorrect or inappropriate.



    I appreciate this is not the response you would have been hoping for, but as I stated earlier, Registry Trust are not legally allowed to amend the Register without confirmation from the court.

    I wouldn't bother with a notice of correction as you'll just have to remove it anyone once this is all sorted - and it's not likely that you are going to be applying for credit with this CCJ on your file anyway so anything you add to your file probably will never be seen by anyone.

    Seems a bit silly that they didn't record the personal particulars of your father on the records, but the courts will have this information - sounds like you need to contact them and get them to pass along all the info back up the chain

    An update on this.

    I called the court, who said it had been correctly recorded by them and it must be an admin error on Experian's end. I then called Experian who, from looking at it, designated it a clear matching issue and wasn't sure why it had been placed on my report.

    A week later, and Experian have removed the CCJ from my report. However, my MSE Credit Club report hasn't updated. From contacting MSE Credit Club, this will take effect on my next update to the report (about a month away). I'll hold off on applying for anything until then.

    Your MSE report is a monthly snapshot.

    If Experian have removed it then lenders will no longer see it as they see your "live" report not a snapshot one.

    If you want to be certain it's gone then sign up to the MSE Credit Club with a different email address to see an updated report.
