Not really but I’ve asked for advice. If someone come back and said, you’re out of luck I’d say fine.

And if it’s a case as to why should the council repair it......then why should they repair other potholes on the road? I enquiried to the council as a first port of call.

Unfortunately I’m not sure I’m the only one who has had problems. It’s a build up, every time scrapping my sump but this one time it hit it too hard and put a hole in it.

One of them things unfortunately, people claim for damaged alloys etc so thought I would enquire.
That’s where you have a problem. Even if you wanted to make a claim, you knew about the potential problem but carried on using the road anyway.

When people make claims against councils for damage, one of the common reasons their claims are unsuccessful is that the pothole wasn’t reported. It’s unreasonable to expect the council to inspect all roads daily and therefore, claims are usually successful where a pothole has previously been reported and the council haven’t dealt with it in a reasonable time.

In your case, you knew of a potential problem but carried on anyway.

Thanks for the info. That’s what I though to be fair. It’s unadopted so the council won’t do anything anyway. They’ve already said that.

Just one of those things really. Never mind.

As to the person who suggested driving better.....a 10 inch pothole with cars parked the other side doesn’t really make that easy.....but you know best say behind your keyboard. Cheers for the help mate

The council repair roads that they are responsible for.
They are not responsible for a road that they have not adopted. Thats what adopting it means- the council take over responsibility for the road.

Yea I didn’t know it was unadopted until afterwards when I spoke to the council.

I was after some advice as to whether I had a case as I have had help on here before so tried it. It’s as I thought unfortunately....never mind.

Any advice would be greatly appreciated positive or negative.

You claim ANY advice is good, even negative but when you get advise you don't agree with you seem to have a knee jerk reaction. Why ask for something you don't want?
