Vehicle damage on unadopted road
Options
Good evening guys,
I'm looking for some advice. My vehicle got damaged by a pothole on an unadopted access road by my garage.
I know it's unadpoted because I have contacted the council and they have informed me that the company that owned the land went into liquidation and the treasury now own it so they are not taking any responsibility.
The garage is privately owned by another company and opposite there are other garages that aren't owned by the same company. The garages are located on the top/back of a cresent and there are maisonette dwellings all round the cresent. I've been told to contact the residents association but I very much doubt there is one.
Is there anything I can do to claim the cost of the repairs?
I have a video showing where the damage happened and the trail left by my oil. I have photos of the exact spot where the damage happened aswell as a photo showing the measured depth of the pothole so the evidence is there.
Any advice would be greatly appreciated positive or negative.
Thanks in advance.

Without knowing who owns the land or how to contact them, you can't even begin to claim. Even if you were to ascertain the right owner, you'd probably have to show that the pothole was previously reported and that they hadn't repaired it within a reasonable time in order to prove negligence on their part.0

They’ve told me it’s the treasurey as the land was repossessed as the company that did went into liquidation.
The council told me this and also said it’s the residents associations responsibility to resolve the problem. So this hole is going to get bigger and bigger........0 -
Because I’m a resident am I?
I use it for access, that’s it, not even once a week.
Maybe if that’s the case then the council, who empty the bins can sort it.....or the company that sorts the street lighting can sort it..........plus I’ve bags of money to pay for it when there’s a hundred plus residents living down there using it also......
Why bother commenting if you’re not going to be helpful? Waste of your time and mine. Thanks anyway.0 -
Did the pothole hit your car?
Why are you looking for someone to claim from?
If the repairs will be expensive you can claim from your own insurance and keep an eye out for potholes in the future.0 -

So 100+ people use it without issue every week.
You use it once a week and damage your car.
There's nobody to chase here(or worth chasing). you need to prove neglect for a start.
I doubt the treasury has a responsibility to you to maintain the road for access.0 -

Are all suggestions that you dont like going to be deemed unhelpful?
Why is it the councils obligation to repair the road?0 -
Not really but I’ve asked for advice. If someone come back and said, you’re out of luck I’d say fine.
And if it’s a case as to why should the council repair it......then why should they repair other potholes on the road? I enquiried to the council as a first port of call.
Unfortunately I’m not sure I’m the only one who has had problems. It’s a build up, every time scrapping my sump but this one time it hit it too hard and put a hole in it.
One of them things unfortunately, people claim for damaged alloys etc so thought I would enquire.0 -
The council repair roads that they are responsible for.
They are not responsible for a road that they have not adopted. Thats what adopting it means- the council take over responsibility for the road.0 -

It's not council tax payers responsibility.
All the other 100s of users, have they damaged their vehicles or do they drive more slowly?0
