    Thanks for replying guys-is it fair to say i can defend with a multi point script or just one strong point in court- just been to take some pics of the site that had cameras removed along with the signs a while back- dont think they had any line markings in the car park either at that time,certainly not there now...so i would defend with ABUSE OF PROCESS the added extras ,LACHES circumstance change. No bay to park in so not possible to break parking TC,s of parking appreciate any advice-thanks

    Those are not 'extras' and are significant defence points. Use them all.

    There is no defence to a parking charge (as such) called 'abuse of process' so please don't misunderstand what that point means, it's merely damage limitation to minimise the costs if someone is about to lose, OR (on the other hand) costs boosting for yourself by setting out their unreasonable conduct, to claim higher costs if you have just won!

    Not a defence point.

    I hope you know what to expect next and have re-read bargepole's post.

    thanks again guys!sorry coupon mad the Laches was in reference to them breaking contract with the landowner as circumstances have changed,,not the parking bays.........abuse of process! i get that ,hope the judge nails them for trying to add costs-or just throws it out complete......i me gona get a big gun loaded and fire a barrage of bullets (if i get a court paper?) i will post any news after hearing- cheers Brewdog

    update- i have just received a complete pack of detailed information from BW Legal, i kept every piece of paper that has trailed since 2015, including threats from ZZPS and WRIGHT HASSLE
    The interesting and best bit that i did not have to hand were the pictures of the car park from 2015
    there are NO lines marked,no parking bays to park in ,just an area of tarmac, i beat a council over a parking ticket claim because they had no lines marked- is this picture my holy grail piece of evidence?
    no lines=no contravention,this makes me wonder if thats the reason why Premier Parks removed the cameras and signage

    Not having any lines may help your case, but never think of it as a holy grail. A bay could simply be interpreted as a space between two vehicles or a vehicle and a wall. You will be playing judge bingo and need to convince her/him of your case.
    Use every point available.
