2nd Try?

Hi all,
Was refused a claim by the Halifax over a year ago.
Like a fool I accepted their refusal and did not contact the ombudsman.
An I able to try again?
I have filled in their online contact forum for a call back but, was hoping for clarification if my 2nd try is ok before the call me.

    Why "like a fool"? they would have outlined the reasons for rejecting the complaint. You are outside the timescales for going back to FOS and all the bank will do is send you a copy of the original response. Move on

    Did the bank reject you? RESTART your claim. Banks have been fined repeatedly for failing to deal with complaints properly. Many have been WRONGLY rejected. After all, the Financial Ombudsman upholds more than 60% of PPI cases in consumers' favour, even though to get there you need to have been rejected by the bank.

    If you were rejected and didn't go to the Ombudsman, try again... Unless you were rejected in the last six months, you need to start from scratch with your bank

    I'll start from scratch add it's not August 29th yet, no?

    As far as I'm aware, no, it's not yet August 29th.

    But they will still refer you to your original rejection.

    The lender can look at a complaint again if you have new information e.g. complaint reasons not previously used or fresh evidence.

    Whatever "Martin Lewis" (or whoever) says in an article on this site, you cannot keep repeating the same complaint over and over. If you "start over", you will just be met with a terse reminder of the result of your original complaint.

    The Bank has already responded "fully and finally".

    Only if you now have very compelling evidence not included in your original complaint would you stand any chance of having your case reopened. You won't have additional access to the Ombudsman in any case-it's the same complaint.

    Your PPI journey ended over a year ago.

    That is woefully out-of-date.

    In 2017, the PPI uphold rate at the FOS had dropped to 40% and latest figures (between July 2018 and December 2018) show it dropped from 29% in the previous six months to 20%.

    It is also typical of an MSE article. Not unfairly so but you need to understand how MSE gets its message across. It has to keep things short and simple. That means saying things that are heavily simplified and leaving out all the caveats and issues. They dont want to put anyone off.

    A small number of banks were told to go back over old complaints and review them. People involved in those issues should be automatically contacted in time but if you complain again, if you were on that list, they would bring you to the front.

    You only get one bite at the cherry. Halifax should refer you back to their original decision and not reconsider your complaint.

    If they rejected your complaint,you had six months to go to the FOS. You are out of date to complain now and if you complain again without new evidence they will reject again.
    You can ask them to consider Plevin if it applied but they have probably already considered that.
