If you lost in court you would have to pay about £175-£200, not much more than they are asking for now.
Personally I would wait to see if they actually try a court claim as many companies don't. If they do try court and add on fake charges, which is what has happened so far, then you ask the court to have the case struck out as an abuse of process as per similar cases.

In your POPLA appeal did you "out" yourself as the driver?

The current challenges sound like an intensive but nonetheless rather useful preparation for the modern professional workplace and life in general! Hang on in there.

What happened when you contacted the land owner
You haven't described the alleged infringement ...
So if there were mitigating factors e.g. illness or a stressful situation, if the car park serves a retail outlet or restaurant etc. that occupants of the car regularly spend money in or at least did spend money in on that occasion, if signage was lousy, if a payment machine may have been faulty etc. etc. etc. .... complain vigorously to the landowner demanding cancellation even at this stage.
You'd need to identify the landowner and then write a damn good email. More work, obviously, but not too time consuming.0 -
More often than not, advocates fielded by PPCs at court only receive the paperwork the night before and are pretty clueless when it comes to arguing the case. Some are rather hapless saps.
But court is a lottery - for all parties.
That is so true. The Claimant's representative at my hearing was chewed up and spat out by the judge. Some judges dislike the parking companies as they abuse the court system and will find in the defendant's favour providing that they have something to work with.
I do understand the situation that you find yourself in. It is unfair that these parking companies can bully and harass people to pay these spurious claims and to contest this the person has to be dragged through the court process. Hopefully things will change.
During the process there are periods where nothing will be happening. There are also good defences on this forum which you can adapt to your own scenario.
It's possible that you may get an offer. DRP and Zenith did in my case. You will also have the opportunity for mediation which is not recommended but you could give it a try you don't have to go with it.

Correct, I'm in England and didn't address who the driver was. I used and amended a template.
I do feel like a bit of a letdown, especially, as everyone on here puts so much effort and time into not giving in to their demands.
I tried to contact the landowner, but had no luck, it is a gym that is part of a chain. It shares a car park with the Royal Mail, and car park spaces are not clearly identified. Signs are only visible if you take the road, but cutting through the spaces, you encounter no signs.
Hopefully, no letter gets sent, or perhaps I get a lenient judge. This thread has actually helped quite a bit. I guess, I just have bad experience from my ongoing case and assumed it would be as intimidating and draining.
Perhaps I will wait out, hopefully, worst-case scenario sees the maximum fine being not much more than it is currently.
