Complex CCJ situation

In a nutshell:

Recieved a CCJ 3 or 4 years back. Started making payments monthly and it actually cleared a few months back to be satisfied. However upon being satisfied i started looking at this in more detail and found the amount was incorrect!

I went to go and complain to the company and have now found they have been dissolved for the last year!

How would i go and

a) go and complain
b) go about trying to get this CCJ set aside
c) speak to them about signing a constent form

Tricky situation. Anyone with advice?

  • How is the amount incorrect?

    A CCJ includes interest and court charges amongst other things so it’s always higher than the original debt.

    Given that it’s 3 or 4 years old there’s little point in getting it set-aside as this will cost an additional £255 and it’s severity has worn off greatly.

    a) Complain about what exactly? (You have said the CCJ was satisfied)
    b) Set aside on what grounds?
    c) Speak to who about what consent form?

    The amount is incorrect because they have overcharged me. I included all the court costs etc and its more then it should be.

    I realise it costs 255 but its worth it if i can have it set aside

    A) - complain about the amount of money i was charged as it wsa incorrect
    B) set aside on the incorrect amount of money
    C) consent on the company to remove the CCJ
  • Overcharged you how?

    The CCJ notice will have the breakdown of what you’re being summoned for.

    And why has it taken 3-4 years to realise this?

    the charge was wrong. The amount was over what it should have been from the loan. Ive included everything and worked it all out

    ITs taken me so long because of my own negligence so no-one to blame but me

    However i am looking for solutions. The fact they are dissolved puts me in a prediciment so unlikely i will get any money back. But can i at least get the CCJ removed and if so, how
  • No you can’t get it removed.

    Your calculations are (no offence) likely to be incorrect and will be dismissed.

    You just need to wait the last 2-3 years out for it to be removed naturally.

  • Based on what calculations?

    You need to include interest, late payment charges/fees, court fees etc.
