They have 30 days to deal with a SAR, says so in your SAR, so 5 days is an excellent turn around

I have a meeting coming up with my local mp to discuss course of action following my email

Im reading other similar defences to help me write up my own defence

Planning on visiting the location to take pics of signage and roads around

Also will try to obtain street view images from around the alleged offence date

I will argue the added on solicitors cost on my defence. However I've read posts by fruitcake advising to contact the court and ask for the case to be struck out due to abuse of process. Do i simply need to make a phone call when my case gets allocated to local county court?

Also at the time of the alleged offence, anpr cameras were put up immediately with the signage, if not before. Is there any ruling that the ppc must allow for some period of time before "fining"

Hi all, could someone please have a look at the above questions and provide me some answers please.

Further to the above, I have received information from the sar from MB. They have assumed that I am the driver as my details were supplied by the lease company. The pic taken by the anpr makes it pretty clear who the driver could be. Can the pic be used to identify the driver?

    Timeline of events
    Early October 2017 contravention occurred
Mid November 2017 NTK (hire company) issued
Few days later hire company provides details of hirer
Late November 2017 NTD (which ought to be NTH) issued

Is this within the required timeframe? The first correspondence I received from MB as hirer was 56 days after the alleged contravention.

Furthermore, in late December 2017, I received a demand letter stating as I had not paid, the PCN had been passed onto internal collections team and an additional £55 was added. I replied to this by requesting better particulars. I also requested a POPLA code if MB were not willing to supply requested details. MB did not acknowledge my appeal and proceeded as usual.

Does adding on additional costs and failing to reply to my letter work in my favour?

    Please help
  • Any thoughts on the above. All comments will be much appreciated.

No responses since a week ago. I understand this is a voluntary service provided. I am a little confused and answers to my questions above will help me draft a good defence.
  • Hi all, the above pcn have been cancelled following SAR from minster baywatch. I am in no luck as I have another pcn. This time from g24 ltd and I have been photographed parked outside marked bay. Similar circumstances as leased car and I have received pcn after leasing company provided my details. Can anyone please help me on how to respond as I was parked outside my bay due to the car on my right being too far over. Also it was very dark, unlit and raining so was difficult to see the marked bay.
  • Any help please?

Appeal using the text from the NEWBIE sticky post # 1, if it is leased car, used the text from Edna Basher not the blue text. If/when this is rejected (assuming it is a BPA PPC) appeal to POPLA. If/when that fails look out for LBC, followed by court papers and prepare your defence.
  • Thanks for the reply. I have not come across many cases relating to a car parked outside a marked bay. Could you please help me with these and any rulings relating to when parking outside a marked bay is deemed okay
