Hi everyone Ive gone through the Newbies sticky
But can’t find one like mine. The driver got a PCN for parking on a ‘private’ land i.e. Toby carvery car park. Car was parked for 25 mins it seemed like it was free parking it had no signage anywhere to say it was private or you had to pay. Letter states the car wasn’t authorised to park there what does that mean? Should the driver just pay the fine or is it best to appeal?

letter has gone to the keeper , not the driver
of course its private land, if its not council or public roads or whatever then its private property
chances are that visitors have to put their VRM details into a terminal inside the building on the bar, to obtain free parking (like an IPAD for example)
the driver should stay on public roads and stay off private property unless they have permission from the retailer or business etc , treat them all as traps, also bear in mind that usually the driver only gets ten minutes to decide what to do, not 25 minutes

Who is this ticket from? If it's from a ppc then it's exactly the same as all other tickets.0

Just go in and complain and they will cancel it there and then.0 -
Very surprised there were no signs - most unusual.
If the branch manager is unhelpful a polite complaint to the CEO may get this cancelled:-

The PPC who issued the NTK is Euro Car Parks my issue is yes the driver might have parked on private property unknowingly and might have not even gone in Toby Carvery...there were no signs at all showing its a customer only parking or they using cameras to record vehicles in and out. Is it worth the hassle or should The driver just pay the fine?0

This sounds rather nebulous, surely you must remember the indigestion you suffered for three days if you did eat there.
BTW, it is not a fine, the stickies make that clear, have you not read them?
However, if you did eat there many judges regard failure to enter one's vrn in a tablet as a very trifling matter, read this,

As Nine times out of ten these tickets are scams, complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

No signs at all??? This does seem very unlikely. Much more likely that there were signs but the amount of signs and the positioning and clarity of signs fell way short of the BPA standards.
If occupants of the car were customers then complain vigorously and insist on cancellation.
In any case, it sounds as if there is a basis for a POPLA appeal majoring on signage probably.
POFA 2012 would be another section. You'll need to know whether the NTK you've received is POFA compliant. I think ECP NTKs usually are but you can find out what this means and how to check by reading the Newbies' thread and searching the site for other ECP cases.
You've identified the driver in at least one post in this thread - need to edit post 7.
I doubt very much that the initial appeal will be successful. They usually aren't and are a mainly a way of getting a POPLA code. Do some reading around here to decide whether or not you're up for a POPLA appeal.0
