Spoke to ALDI, managers, they've abdicated all responsibility as they don't set the minimum purchase amount. Emailed CEO but not hopeful I'll get a reply in the 14 days until it goes up to £70 - help please, I work in a sector that can't have a ccj attached
    What??

Are you still considering their fake discount?

Do you realise that if you were to pay their discounted amount, they will see you as a sucker and be back for more - giving a weak excuse why the discounted amount wasn't applicable.

Anyway, as you 'work in a sector that can't have a ccj attached', you will of course know exactly how you get a lasting County Court Judgment against you.

But just in case anyone else reads this let me spell it out:
    1. there has to be a court case - there hasn't even been a hint of a court case yet.
    2. you have to lose that court case, or not bother to defend it.
    3. you have to fail to pay what the judge orders in the timescale he allows.
To summarise, you are in total control of whether you get a CCJ or not. If you don't wan't one, you won't get one.

If you have used your real name as your forum name then you need to get MSE to change it to something anonymous

The ppcs monitor this forum and can use posts in your thread against you in Court

For get their bribe that is exactly why they do that, can't you see through their scam, as you have been told you can't just get a ccj, and in reality you don't have to actually pay this unless a judge tells you to.

Despite hundreds of thousands of tickets issued by PE for Aldi car parks, there has never been a reported court case.

It is believed that Aldi won't allow PE to persecute their customers beyond standard extortion and threats. There's no CCJ in sight for you whatsoever.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The 14 day mugs discount is for mugs.

Appeal using the template in blue text from post 1 of the NEWBIES. Send it unaltered from the keeper.

If it is rejected, construct a PoPLA appeal using all the points available to you from post 3 of the NEWBIES. Add Frustration of contract as point 1.

This is where you point out that the scammers are lying when they say the Ts and Cs are displayed on their signage because we all know the discretionary spend is not mentioned.
It is believed to be about £30 but has never been seen in print by the public. Perhaps you could ask the CEO how much and say you could have avoided the PCN had you known.

Also complain to the BPA that there is a hidden clause in the Ts and which forms an unfair contract term. How can you agree to a contract if you don't know ALL the terms?

Complain to your MP about this unregulated scam.

There are two points for the CEO

The OP says that they went to buy a product that was not in stock.
This is the fault of Aldi and not the customer.

The signs say that parking is FREE for xxxx time
Adding a minimum spend to achieve this would be false

There's only 3 days left til I need to appeal to POPLA, I've heard nothing from ALDI head office or the CEO and I'm getting worried I'll end up with a court order, which I can't afford. Any suggestions?

Appeal to PoPLA... or am I missing something here?

That suggestion was made on the same day as your original post on this thread.

Don't lose your opportunity to appeal to popla

Post up your draft appeal here for comments before sending it

But do that quickly so there's time for the comments and for you to make any changes suggested if the deadline line is so close
