    Before Deputy District Judge Avis sitting at the County Court at Southampton, London Road....

    IT IS ORDERED THAT
    1. The claim be struck out as an abuse of process as it contains, and is tainted by an additional charge of £60.00

    2. The court has made this Order on its own initiative pursuant to Rule 3.3. of the Civil Procedure Rules 1998. Any party affected by this Order has the right to apply to set it aside, vary or stay it by application made not more than 7 days after this Order was served on the party making the application.

    Super result, and as each 'Abuse of Process' case gets thrown out, the greater the evidence builds (and the word spreads) that Judges are dismissing the entire claim, not just the £60 try-on. Chance biting off more than you can chew (PPCs and Legals), the more likely you are to choke. Happy gagging! 😛

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully, when life gets back to normal, it will become impossible for those scammers who are left to continue their vile trade, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
