  • I have received another letter today from BW Legal stating they will issue a CCJ against me unless I respond to them or the county court claim by 27th Jan 2020.

    They need to change their name to BS Legal.

    I am going to submit my defence later today unless any changes need to be made to it or the body of the email as shown above.

    I would like to see how they do that! As you know, you need to go to court and lose the case and fail to pay within the timescale set by the judge before a CCJ!

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Not much wrong with that.

    Perhaps it should say:
    "If you do not contact us or respond to the county court claim, we will seek a County Court Judgement ("CCJ") against you after 27 January 2020."

    They are really saying that if you haven't filed your Defence by 27th January, they will press the button which will give them a Default Judgment against you.

    In fairness, they appear to be offering you an extra seven days to file your Defence. Don't be taken in by that. They can seek a Default Judgment anytime after 20th January and may well do that.

    As I said earlier...
    ...you have until 4pm on Monday 20th January 2020 to file your Defence.

    Quick update on my case. I submitted my defence along with the email asking it to be struck out as abuse of process. I then received further correspondence from BW legal - a 'response to your defence' they then went on to dismiss all of my arguments. I'm guessing that is normal. Within the same letter they have made an offer to "resolve matters" which includes me paying £180 and them dropping the case. I made no reply. 

    My next correspondence from BW Legal was their clients questionnaire and information regarding a small claims mediation service. 

    I am now at the stage where I need to fill out the Small Claims Directions Questionnaire. I have reviewed the notes on how to answer the questions as per the Newbies Thread. Am I right in thinking that as I replied to the claim form using MCOL I can upload the questionnaire there? Also can I email a copy to BW Legal or am. I required to send it in the post?

    You send the DQ to CCBC using the same e-mail address that you used for your defence.

    Of course they will dismiss your arguments, BWLegal cannoot face the truth ???
    By offering a settlement sum and mediation suggests they don't want to go court.   If they are so certain they will win would they really start offering discounts ?????? Don't think so.
    Even at £180, you are being scammed.. I guess now they continue and get their spanking in court or they discontinue.  What other option do they have ???

    Great I will get my DQ off to CCBC later today. Is it acceptable to email it to BW Legal? I do have to serve a copy to them don't I?

    You serve it on BW LEgal or whoever is named as claimant by whatever means are allowed on the claim form.
