    then you appeal within the 28 days , on say day 26

    then you still had 28 to 32 days for the Health Centre to cancel it before any POPLA appeal was submitted around day 31 following the popla code date

    we would have told you to include signage because the Health Centre should have had notices up where the terminal is and ensured that you had completed it when you signed in for the appointment, to avoid this situation , so poor signage, wherever it was and by whoever posted said signage, you should have been fully aware of the requirements, you werent

    as for the MP angle , you are completely wrong

    we have known other pcn,s on here where the MP has complained to the Health Centre direct and obtained cancellations for constituents

    you have not considered that possibility, despite the fact they may have done this for other people

    I know my MP has intervened with ECP and my local Morrissons and obtained cancellations for similar issues, but you havent been doing this for 7 years like me and over 10 years like coupon mad

    I once (last year) told a friend to do so and copy in Morrisons head office email mentioning the MP complaint, it was cancelled the next day by Morrissons and ECP (same company as yours)

    I am pretty sure my's intervention in a PCN was instrumental in getting it cancelled.
    You never know how far you can go until you go too far.

    Nobody said you shouldn't go to POPLA. The big mistake was how you worded your appeal.

    At the top of this board is a thread that tells Newbies to read it first. In it is a ready made initial appeal template and POPLA templates. The hard work is done for you!

    Sadly you did not find it and have sent a half baked appeal that stand little, if any, chance of winning.

    The good news is that the Newbies thread as it's known tells you what to do if you get debt collectors letters and if you get court papers.

    You really need to read it.

    Withdrawing a PoPLA appeal would, in my opinion, be unwise.

    Having withdrawn a PoPLA appeal, you are unable to appeal to PoPLA later.

    Just to update everyone, POPLA contacted me and said that EURO CAR PARKS do not wish to contest my appeal, and thus I have succeeded.

    So thank you to all that told me I had made a big mistake in contacting POPLA, turns out you were wrong, but I want to help other people and let them know how my case worked out.

    Internal appeal process with operator failed, but I then succeeded with POPLA.

    Thank you, but I never once in my life wrote a half baked appeal for anything, and consequently I have never lost an appeal I didn't see through to the end.

    I've brought legal firms down to their knees, simply with my ability to write, writing is my daily job, and I am gifted.

    POPLA accepted my appeal, and I succeeded, thank you for your time and interest in my case.

    I think there was a misunderstanding here.

    POPLA decisions are very unreliable and therefore it's extremely hard to second-guess which appeal point may win. Sometimes the section cited by the assessor as the reason for success appears nowhere near as compelling as other sections. That's why the recommendation on here is to cover all relevant points.

    And again, in theory, 'mitigating factors' don't win. Absurd as it sounds, I think attending a doctor's appointment and using the surgery's car park comes into that category.

    Nobody said that you shouldn't do the POPLA appeal! I think the misunderstanding would have been ironed out sooner except for the fact that this forum is unbelievably busy. There are plenty of folks here who are at the court stage relying heavily on a handful of volunteer posters to guide them through the process. Actually, looking back, several regulars emphasised that you should do a POPLA appeal, but you still insisted you'd been given wrong information.

    I like your confidence re. appealing etc. but a lot of highly intelligent people who are not familiar with the wily ways of the PPCs do lose if they rely on reason and persuasion alone.

    I'm very glad to hear your appeal was uncontested. It's the right result, that's the main thing. But there's no way of knowing what it was that made ECP back off. Had they not backed off it would have been down to the POPLA assessor to decide and the fear was that your appeal would not have passed muster.
