Euro Car Park PCN at NHS Surbiton

I received a PCN at a Health Centre run by the NHS from the operator of the car park known as Euro Car Parks. I have already scanned through much of the material on this operator in this forum, however I was a patient at the health centre at the date and time on the PCN and had full authority to park there, and this is the basis of my appeal.

I have already appealed internally, which was rejected, and then I appealled again via POPLA with evidence of my confirmation appointment and NHS Number.

If that gets rejected too, what do I do next? Nothing?

I have not appealed on the grounds of poor signage as I didnt even look because I knew I had a right to be there as I was a patient but I just didnt realise I had to submit my license plate number at the reception, this was my first time.

    Complain to the NHS Health Centre manager. They could cancel it all along.

    Why then, when scouring through all the posts, the typical advise is to appeal, not ignore??? And then you say "oops, wrong move" lol ?

    So do I retract my appeal from POPLA and speak to the Health Centre?

    Have they complied?

    If not complain to PALS and your MP.

    Nine times out of ten these tickets are scams.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.
  • Haha, thank you for your response, seems a bit drastic taking this to the MP? Fair enough, I just want to deal with this PCN first.

    A landowner complaint with direct cancellation is always preferred and should always be tried before a popla appeals

    Not only has cm wrote this mantra in the newbies faq sticky thread but she has campaigned for almost a decade about this topic so only a fool would ignore here advice

    Which is why complaining to the health centre should be the first contact, louse second contact after a PPC appeal, before popla is tried

    You don't ask, you don't get

    As for the MP complaint, they have been involved for several years and enacted a law to curb these excesses, but we are still awaiting the Cop to arrive and a date for implementation, hence why it's an MP task as well

  • How exactly does this help me now? I asked what I should do now... do I retract the POPLA and contact the health centre?

    I am simply asking for help in my current situation, I never read anything about not appealing or not going to POPLA.

    POPLA was everywhere, everyone was saying ignore euro car parks they have a non existent track record of taking people to court.

    nobody is told to ignore a pcn on here, only to ignore debt collectors

    everybody should know to complain to the landowner first, the NEWBIES thread says so

    a landowner cancellation to the PPC will tell them to withdraw from popla and save the popla fee , ie:- no contest and no evidence pack submitted , no commitment

    popla is second to last resort

    court is the last resort

    wake up and smell the coffee, all this is common sense, nothing more
    everything we say helps you, that is the idea, even if you are in ignorance of the topic

    if I slipped on a wet floor in tesco and it cost me money, I would complain to tesco direct, not to their sub contractor


    various PPC,s never used to issue court claims, but many have changed their minds since the 2015 Beavis decision


    ECP could easily dump millions of pcn,s onto B W LEGAL or similar, same as Britannia etc , how can anyone on here say it will never happen ? think about it (I know I would if I was in business and put profit before people) , it is OBVIOUS that it could happen within 6 years

    meanwhile , its up to 6 years of debt crawler letters and threats

    You don't seem to understand my question, so I'll deal with it myself, and if I learn something new I'll actually help someone and talk to them clearly.

    I definitely understand your question, and your circumstances, but you have a closed mind to the answers because they are not what you wish to hear

    you joined in 2016, you have 100 posts on MSE, you talked about everything you have read on here , that you also read about POPLA and about ECP not issuing court cases, now you are pleading newbie ignorance and blaming others for your lack of knowledge

    you even dismissed the MP angle and laughed at that poster even though they understand this a lot more than you do
    the correct answer is

    OK, I will do what you all say even if I do not understand why, I will complain to the Health Centre and try to get it cancelled

    obstinacy will lose this for you and you will regret it if it goes to court, due to the hassle and time required

    you are being a fool if you think that POPLA will uphold your appeal

    you can lead a horse to water, but you cannot make it drink !!! even if it is dying of thirst

    No I asked multiple times, do I withdraw the POPLA appeal first?? This is what I wanted to know before speaking to the health centre, because the first poster was like "OOOOOPPS BIG MISTAKE" shouldn't have gone to POPLA, making me feel like I ruined my chance of going to the health centre.

    I just wanted to hear something like " Don't worry about the POPLA just speak to the health centre" or "yes withdraw the POPLA appeal, then speak to the health centre"

    Simples.

    I didn't say POPLA will uphold my claim, I just listened to you guys who said don't ignore, appeal. So I appealed.

    I did not dismiss the MP angle, I fully understand the MP angle, I've done that for other things in the past. But the MP is not going to take away MY PCN ANYTIME SOON, the MP angle is a nice thing to do ... but it won't help me with my current PCN will it ? No it won't/
