I am not sure but i explained the situation clearly to the solicitor and ive got similar responses when reading through other forums so there must be some truth in this
Can i ask you when you did your consent form and sent to the court with both parties signed, was it mentioned anywhere in the forms that you sent to the court or the party signing it about your circumstances of address change etc or was it a simple consent form that both parties agreed to waive the CCJ0 -
I didn't do the consent form, the solicitors for debt company sent me the consent form and asked me to sign it and return it so they can file it with the court, the change of address and everything else you mentioned was stated on the original application notice I sent to court which was to challenge the matter in court. I told the court of my circumstances and they sent a copy of my application to the solicitors to show I wanted to challenge the matter in court, the solicitor's wanted an out of court settlement, hence why they sent me a consent order to sign and for them to sign to have the CCJ removed.0

I see, i think because your case was clear cut and the solicitors knew they were in the wrong this is why the matter was resolved quickly. It looks like the court already have your information about the ins and outs of your case and that helped. Do you have a copy of the consent form or give me a rough idea of what it actually stated on there.0

Id probably say if your thinking about me that much you should go get a hobby because this is just not healthy. FYI - not trying to get out of any debts i owe, i fully intend on paying any amount owed. As for loophopes; i am trying to understand the law and my legal rights. This is also good information for anyone reading these threads, which is what the forum is about.0 -
The fact is you owe the money.
You ignored or “didn’t receive” letters and it’s led to a CCJ.
Also as per your other thread, make a SAR request to Lowell and see if they did indeed send these letters out.
If you know you indeed owe it just pay it and move on - stop looking for loopholes and get out of jail free cards.
Everyone’s situation is different so what applies to you or any other poster, such as ones in this thread, won’t apply to everyone else.0
