Hi all, sorry for the new post, however I cannot find the answer I'm looking for elsewhere. I have received a number of letters from Horizon Parking for parking on private land which have been ignored. I have now received a letter from Gordon & Nobel stating I've to pay £1440 for 12 offences between 16/01/18 and 11/03/19. I have a couple of questions regarding this: I was not the driver although I am the keeper but should I email them stating this or not bother. Also does the amount seem excessive? I am in Scotland so I know the rules are different than other parts of the UK hence the uncertainty. Any advice would be awesome please. Thanks

Yes it may be worth telling them you weren't the driver. They won't believe you but it sets your position out.
Do not name the driver under any circumstances.

I can't prove I wasn't driving sadly no. I have seen the link saying they are cowboy's which are part of the reason I don't know whether to get in touch or not as I don't want to give them ammunition to starts bombarding me and I don't want to contact someone who isn't genuine. Confused!0

Can you state categorically that you were not the driver on 12 quite separate occasions? If you state that and it gets to court (unlikely in Scotland, but with multiple tickets, never say never), you're likely to have to prove it.
How come parking tickets have been racked up 12 times?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I can say it wasn't me but cannot prove it. Without naming the driver and them being willing to pay the charges I have no way to prove it. I'm not sure how it has got to 12. I know any tickets that have been issued have been ignored following general opinion that companies in Scotland can't do anything about them.0

Why does OP have to prove anything? Surely the onus is on the scammer to prove he/she was, or are things different in Scotland?You never know how far you can go until you go too far.0

My comment was in the context of the earlier suggestion that the OP writes to say they weren't the driver.
As this is a multi ticket job, with a greater possibility that it might get to court (recognising this is Scotland), can you see a Judge accepting a statement at face value, without question, that on 12 separate occasions over a period of 14 months, the defendant wasn't the driver.
That 'denial' being part of the defence is likely to have to be made under a Statement of Truth (if it's the same in Scotland as it is in E/W). IIRC there were a couple of cases reported here or on PePiPoo where Judges put the defendants on oath to confirm their denial. Extremely thin ice then.
My reasoning for asking the questions was to hopefully arrive at a position where I would be advising against making any statement on anything about the driver, unless the OP had categoric proof.Please note, we are not a legal advice forum. A lot of the time these cases boil down to credibility. If the judge (or sheriff in this case) doesn't believe you then you have an uphill struggle.0

Thanks for the help everyone. Fingers crossed this doesn't go to court and I don't have worry about it. Needless to say I drive me car and only me now and only park where allowed.0
