myparkingcharge - VCS?

Can I just check that myparkingcharge.co.uk is actually VCS and they are a member of the IPC?

I've read on a thread somewhere that they are NOT but I have looked them up and they appear to be a member.

I've now had the letters stating that they will take me to court over the £100, reduced to £60 and now £160 'fine' + court costs.

Not looking forward to this as I don't think I can defend myself against someone who is legally qualified!

They are part of Excel/VCS who are IPC members.

Have you read and followed the advice in the NEWBIES? Has the keeper appealed?
Please give us more information so we can help you better.

Yes you can, everyone else does and they are all newbies and 99% win. With our help and your preparation, you can beat them. Wort case scenario you at least expose their lies about the £60 they've unlawfully added (double counting, as the letters are already paid for from the £100).

Tell us which car park and what alleged contravention?

No doubt you have seen the Court defence examples in the NEWBIES post #2 and noticed there is one already written for VCS hybrid 'not a parking charge' cases?

Nine times out of ten these tickets are scams so complain to your MP.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

I'm currently gathering what I think is 'evidence' to support my claim.

In a nutshell there is a parking area adjacent to a leisure facility on an industrial estate. The leisure facility is one of these combined soft play/climbing wall etc, places. It was a bank holiday and I dropped my kids off for a party. The parking directly outside the leisure place was packed full so I parked in the parking area next door.
I did actually see the sign and it states 'Private Land', 'No Parking On Access Road'. BUT this is where I need to go back and check, I am assuming the access road is the road that runs parallel to the parking areas and through the facility so I didn't actually park on it but in the car park. The parking area is a large, long rectangular piece of land as you expect to find with marked out spaces. What I'm not sure of is if this area is classed as the 'Access Road' even though it's definitely not a road. I don't think it actually leads anywhere or provides access to anywhere as it is totally enclosed with fence/kerb/wall boundaries.

Anyway, the ticketing chap almost seemed to be waiting for this area to fill up with cars and then unleash his ticketing wrath!

I didn't appeal after reading that it's a waste of time, I hold my hands up if I should have gone through the motions but the statements of 'admitting guilt' put me off.

Also, the premises adjacent to the parking area are unoccupied and have been for some time. I emailed the landlords and they told me the name of the company that owns the building. I can't get through to them on their general enquiries number to confirm that they are enforcing/sanctioning this.

Two of the letters I recevied from myparkingcharge state that the contravention reason is 'parked without a valid ticket/permit'. There is no means to buy a ticket as there's no ticket machines and no means of a permit as nobody occupies the site.

So that's it for now, just waiting for the court proceedings as per the final demand letter. It now also mentions the impact on my credit rating, employment prospects, bailiffs etc..
They also quote ParkingEye LTD vs Beavis.

Many other people also got ticketed at the same time.

    Can't say I'm thrilled with!

    ---- edit --
I've just looked on Google Maps to check the area and it's definitely enclosed so confused about the 'Access Road' wording.
    I can't post a link so not sure if it's relevant/useful.

not sure where you read that ???

this is what you need to read

as for your credit rating ...

you have to be taken to court, loose or don't turn up/respond ... then ... refuse to pay ... before any credit rating can happen.

No need for the word 'almost'. You have described the trap these scum firms set.

  • Third 'sticky' - Is this the POPLAR one? Sorry, but need to check that it's the thread number and not link number on the newbies page??!

Also, if it is POPLAR then should I still go through the motions of the appeal to get the obligatory rejection and reference? or not bother?

Can anyone take a look at the parking area for me to shed some light on what is an 'access road', if I can somehow manage to share the pic?

The NEWBIE sticky is the third thread down on the front page of the forum; within that thread you will find post # 3, which is the one related to POPLA.
