    I was under the impression that councils or their agents were not allowed I issue claims under Contract Law.
    You never know how far you can go until you go too far.

    I have submitted it as a supplementary witness statement. I am guessing that if there are further developments of the Abuse of Process story then I can always submit a supplementary supplement.

    You should also file & serve your costs schedule about a week before the hearing, so we often suggest now that people send it with their WS to the Claimant, and include it in the paper file they supply in person to the local court in advance.

    Just checking you didn't email any of your stuff to the CCBC email by mistake, have you taken a ring binder file of your case WS and evidence to your local court (which court was it BTW?).

    And as The Deep points out, Councils cannot operate their land as if it was under contract law. The Govt said so, and the Local Authorities Ombudsman said so. Did you include this in your WS?

    If not, I suggest a quick skeleton argument covering that matter, to accompany your costs schedule. When is the hearing date, mid december?

    Just got back from a weekend away to find two letters from BW Legal and one from the court.
    First from BWL dated 19/11 offering to drop the action for payment of £170.
    Second also dated 19/11 from BWL containing a notice of discontinuance.
    Letter from the court dated 22/11 notifying me of the discontinuance.
    It feels like a hollow victory after all this hassle but they have at least gone away.


    I would be quite happy to document it all and send to my MP if this can help the cause.

    It's pretty clear that BWLegal are incompetent to do this ?
